法治化进程中私力救济的法理研究

【摘要】：公力救济对于社会秩序所起到的作用是有目共睹的，以司法救济和行政救济为代表的公力救济也一直是学界研究的热点。近来，社会实证主义的研究方法日盛，学术研究的热点和学术兴趣开始转移到对私力救济这种非正式的社会控制体系上。有不少学者据此误认为私力救济在当代又得到了重生，这种脱离现实的唯心主义观念将实践和关于实践的理论混为一谈。事实上，私力救济是“一个从来就存在的更广大、更真实的法律世界”。私力救济作为一种自发的社会控制模式，其形迹遍布古今中外。私力救济的盛行必然有其合理性，认真研究和对待私力救济对于解决社会纷繁复杂的纠纷具有重要意义。本文共分为三章。第一章通过对私力救济的一般理论进行论述，初步认识和把握私力救济的本质，为理论命题的进一步展开奠定了基石。本章又可以分为三节。第一节主要对私力救济的概念进行界定，将私力救济定义为：纠纷一方当事人的利益遭受侵害后，通过自身或其他非科层化组织的私人力量解决纠纷的一种机制。第二节从人性观、社会契约论、文化观等角度论证了私力救济的正当性。第三节主要分析了私力救济的权力来源和对它的限定。第二章通过对私力救济纵横脉络的梳理，运用比较的方法揭示私力救济的独特之处，从而对私力救济作出正确的判断。第三章在分析私力救济利弊的基础上，从立法和司法的角度对私力救济进行规范化设计，，有利于充分发挥其积极的纠纷解决功能，限制其对社会的负面影响。文章的最后对于如何构建公力救济、私力救济、社会型救济三者各展所长,相互配合的多元化的纠纷解决机制提出了一点有益的建议，以便于畅通纠纷解决渠道，构建和谐稳定的社会环境。
[Abstract]:The role of public relief in social order is obvious to all, and the public relief, represented by judicial relief and administrative relief, has always been the focus of academic research. Recently, the research methods of social positivism are flourishing, and the hot spots and academic interests of academic research begin to shift to the informal social control system of private relief. Based on this, many scholars mistakenly believe that private relief has been reborn again in the contemporary era, and this idealistic idea, which is divorced from reality, confuses the theory of practice with the theory of practice. In fact, private relief is a broader, more real legal world that has always existed. As a kind of spontaneous social control mode, private relief has a wide range of features all over the world. The prevalence of private relief must have its rationality. It is of great significance to study and treat the private remedy seriously for solving the complicated social disputes. This paper is divided into three chapters. The first chapter discusses the general theory of private relief, and preliminarily understands and grasps the essence of private relief, which lays the foundation for the further development of theoretical proposition. This chapter can be divided into three sections. The first section mainly defines the concept of private relief, and defines private relief as a mechanism for resolving disputes through their own or other private forces of non-stratified organizations after the interests of one of the parties to a dispute have been infringed. The second section demonstrates the legitimacy of private relief from the perspectives of human nature, social contract and culture. The third section mainly analyzes the power source of private relief and its limitation. In the second chapter, by combing the vertical and horizontal context of private relief, the comparative method is used to reveal the unique features of private relief, so as to make a correct judgment on private relief. On the basis of analyzing the advantages and disadvantages of private remedy, the third chapter designs the private relief standardized from the angle of legislation and judicature, which is helpful to give full play to its positive function of dispute resolution and limit its negative influence on society. At the end of the article, some useful suggestions are put forward on how to construct the diversified dispute resolution mechanism of public relief, private relief and social relief, so as to facilitate the smooth flow of dispute resolution channels. Build a harmonious and stable social environment.
