法家先驱邓析之死考辩

【摘要】：杀邓析者何人?驷kB抑或子产,历来争论不止。《左传》记载邓析为驷kB所杀,而《吕氏春秋》《说苑》等文献明确指出子产杀邓析。从文献考证、史实辨析和文字训诂三个角度来澄清这一争论,可得出结论:子产与驷kB并非一人,"杀"邓析者是驷kB,而"诛"邓析者是子产。"诛"并非"杀",争论的出现正是因为混淆了这两个字的意义。其次是邓析因何被杀的问题。有论者认为,邓析是摇唇鼓舌、淆乱是非以谋私利的"讼棍"。事实上,司法与礼法、个人与权威以及逻辑推理与取譬思维之间的冲突,才是邓析被杀的深层原因。法家和名家通常被礼乐文化目为小人,而邓析兼有名家、法家的双重身份,必然为主流社会所不容。
[Abstract]:Who killed Deng? There has always been a dispute about whether Sikb or Zizhen was killed by Si KB, while the documents such as "Lu's Spring and Autumn period", "Shuiyuan" and so on clearly pointed out that "Zuo Zhuan" had killed Deng. From the three angles of textual research, historical analysis and textual exegesis, it can be concluded that Zicheng and SikB are not one person, that "killing" Deng is Sikb, and "killing" Deng is Zichuang. " The hindsight is not killing, and the argument arises precisely because it confuses the meaning of the word. Then there was the question of why Deng had been killed. Some commentators believe that Deng is a "wrangler" who seeks personal gain by obfuscating the right and wrong. In fact, the conflict between justice and ritual law, between individual and authority, and between logical reasoning and analogy thinking is the deep reason for Deng's murder. Legalists and famous schools are usually regarded as villains by the culture of etiquette and music, but Deng's dual identity of both famous and famous schools must not be accepted by the mainstream society.
