城市规划公众参与法律制度研究——美德两国比较分析

【摘要】：城市规划的实践性要求结合具体情况探索适合区域特点的制度设计。在研究城市规划公众参与相关问题时,在注重理论研究的同时要进行具体的实证分析。美国和德国分别作为英美法系与大陆法系国家的代表,其关于城市规划法律制度具有典型性,所以本文以美国和德国为视角研究城市规划中的公众参与法律制度。通过对比美国和德国的城市规划公众参与法律制度发现二者共同点与差异,为中国城市规划公众参与法律制度的完善提供借鉴。
[Abstract]:The practical requirement of urban planning is to explore the system design suitable for regional characteristics. In the study of public participation in urban planning, we should pay attention to the theoretical research and carry out concrete empirical analysis at the same time. As the representatives of Anglo-American law system and civil law system, the United States and Germany have typical urban planning legal system, so this paper studies the public participation legal system in urban planning from the perspective of the United States and Germany. By comparing the legal system of public participation in urban planning in the United States and Germany, the author finds out the similarities and differences between the two, and provides reference for the perfection of the legal system of public participation in urban planning in China.
