如何认识法律的价值——有关价值思维方式的一个经典命题

【摘要】：正"建设法治中国"这一战略的提出,将如何理解法律的价值再一次提升为现实思考的一个焦点。由于"法律只有在涉及价值的立场框架中才可能被理解"(拉德布鲁赫,第4页),所以这个问题在法学界已讨论多年。但事实表明,要回答"法律究竟(应该和可能)有怎样的价值"问题,不仅涉及如何理解"法和法律"①的本质和特性,还涉及如何把握和运用价值思维的方法,而后者更具有哲学的意义。特别是对于我们的价值哲学研究而言,这个问题不仅具有现实的挑战性,也具有方法论的经典案例性质。本文尝试就此谈一点看法,以期促进思考。一、法律的存在与法律的价值
[Abstract]:The strategy of "building a country ruled by law" will once again raise the value of law to a focal point of practical thinking. Since "the law can only be understood within the framework of a position concerning value" (Radbruch, p. 4), this issue has been discussed in the legal community for many years. But facts have shown that to answer the question "what value does the law have (should and may be)" is not only how to understand the nature and characteristics of "Law and Law", but also how to grasp and apply the method of value thinking. The latter has more philosophical significance. Especially for our study of philosophy of value, this problem is not only challenging in reality, but also of the classical case nature of methodology.
