沈家本法律教育思想及其实践研究

【摘要】：沈家本是清末一位著名的法学家,他是中国法律近代化的奠基人,也是我国新式法律教育的创建人之一。沈家本在主持清末变法修律的过程中,提出了一系列的法律教育思想,并将他的思想运用到了实践中,做到了理论与实践相结合,开创了清末新式的法律教育模式,对我国法学教育的近代化有着深远的影响。九十年代以来,大陆的学者对沈家本进行了不断深入的探讨与研究,而且经久不衰,取得的成果十分丰富。但是到目前为止,人们对沈家本思想的研究并未形成系统的理论成果,研究方向亦分布不均匀。当前学术界对沈家本的研究主要集中在沈家本对中国传统法律的研究以及沈家本变法修律的评价和探讨方面,对沈家本法律教育思想的研究较少。沈家本的法律教育思想也是沈家本思想的重要组成部分,不能忽视。本文将沈家本的法律教育思想作为研究对象,就是希望对沈家本的有关思想加以挖掘和细化,并对当前中国的法学教育实践提供一定的借鉴和启示。本篇论文一共分为以下几个部分。首先,介绍了沈家本法律教育思想的产生,主要从他思想产生的历史大背景和个人因素两个方面进行了探讨。其次,介绍了沈家本法律教育思想理论的内容,主要包括实行新式法律教育才能实现国家富强和政治兴盛；实行新式法律教育才能保民安；提倡重设律博士等三个方面。再次,介绍了沈家本在法律教育领域的尝试,主要包括派员出国留学和考察、整理、翻译中西法律文本、兴办京师法律学堂和兴学盛会等四个方面。最后,结合沈家本的时代背景以及他的特殊身份,对沈家本的法律教育思想进行了正反两方面的评价。同时,针对当前我国法学教育中存在的主要不足,提出了沈家本法律教育思想对当代的借鉴意义。
[Abstract]:Shen Jiaben was a famous jurist in the late Qing Dynasty. He was the founder of the modernization of Chinese law and one of the founders of the new law education in China. Shen Jiaben put forward a series of thoughts of legal education in the course of supervising the reform of law in the late Qing Dynasty, and applied his thought to practice, which combined theory with practice, and created a new mode of legal education in the late Qing Dynasty. It has a profound influence on the modernization of legal education in China. Since the 1990's, scholars in mainland China have carried out in-depth discussions and studies on Shen Jiaben, and have not failed for a long time, and have achieved very rich results. But up to now, the research of Shen Jiaben's thought has not formed the systematic theory achievement, the research direction also distributes unevenly. The current academic research on Shen Jiaben mainly focuses on Shen Jiaben's research on Chinese traditional law and on the evaluation and discussion of Shen Jiaben's law reform, but less on Shen Jiaben's thought of legal education. Shen Jiaben's thought of legal education is also an important part of Shen Jiaben's thought, which can not be ignored. This article regards Shen Jiaben's thought of legal education as the object of study, that is, it hopes to excavate and refine Shen Jiaben's relevant thoughts, and to provide some reference and enlightenment to the current practice of legal education in China. This paper is divided into the following parts. Firstly, the author introduces the origin of Shen Jiaben's thought of legal education, mainly discusses the historical background and personal factors of his thought. Secondly, it introduces the content of Shen Jiaben's thought and theory of legal education, mainly includes three aspects: carrying out new-style legal education to realize national prosperity and political prosperity; carrying out new-style legal education to protect the people's safety; advocating the re-establishment of the law doctor. Thirdly, it introduces Shen Jiaben's attempts in the field of legal education, including sending personnel to study abroad, studying abroad, sorting out, translating Chinese and Western legal texts, setting up a law school for teachers in Beijing and setting up a grand meeting. Finally, combining Shen Jiaben's background of the times and his special status, the author evaluates Shen Jiaben's legal education thoughts from both positive and negative aspects. At the same time, aiming at the main deficiency of the present law education in our country, the author puts forward the reference meaning of Shen Jiaben's legal education thought to the present age.
