论我国法律信仰的缺失及养成

【摘要】：法律信仰问题是法理学研究的基本问题，法律价值的实现程度、法律实施的现实效果，都和社会大众的法律信仰有着密切的联系。人们信仰法律，那么法的价值必然能够良好的得以实现；人们不信仰法律甚至厌恶法律，那么法律只不过是一纸空文，不过是统治阶级压迫的工具。伯尔曼曾说过：“法律必须被信仰，否则它就形同虚设”。这一观点对中国乃至世界各国，都具有非常重大的意义。依法治国是我国的一项基本政策，社会不断发展，只有法治国家才是未来国家发展的方向。法律信仰是法治的精神内核，对建设社会主义法治国家具有重大而深远的意义。然而我国现在的法治状况却不尽人意，由于封建传统文化和儒家思想根深蒂固，在民众心中还没有形成现代的法治理念和精神，民众仍然把实现权利的希望寄托在个别领导人的身上，我国民众的法律信仰尚未养成，，因此，必须加快养成国民法律信仰的脚步，否则，法治社会随着国民对法律的逐渐失望而无法形成。本文界定了法律信仰的涵义，介绍了我国法律信仰缺失的原因和表现，并结合形成法律信仰的基础和条件，提出了养成国民法律信仰的方式，以使我国公民的法律信仰尽快养成，加快我国法治社会的形成脚步。
[Abstract]:The question of legal belief is the basic problem of jurisprudence. The degree of realization of legal value and the practical effect of law enforcement are closely related to the legal belief of the public. If people believe in law, the value of law will be realized. If people do not believe in law or even hate law, then law is nothing but a tool of oppression by the ruling class. Berman once said, "the law must be believed, or it will be empty." This view is of great significance to China and even to all countries in the world. Ruling the country by law is a basic policy of our country, and the society is developing constantly. Only a country ruled by law is the direction of future national development. Legal belief is the spiritual core of the rule of law, which is of great and far-reaching significance to the construction of a socialist country ruled by law. However, the current situation of the rule of law in our country is not satisfactory. Because of the deep-rooted feudal traditional culture and Confucianism, the modern concept and spirit of the rule of law have not been formed in the hearts of the people. The people still place their hopes for the realization of their rights on the individual leaders. The legal faith of the people of our country has not yet been formed. Therefore, we must speed up the pace of fostering the national legal belief, or else, The society of rule of law is unable to form along with the national gradually disappointed to the law. This paper defines the meaning of legal belief, introduces the reasons and manifestations of the lack of legal belief in our country, and puts forward the way to cultivate the national legal belief in combination with the foundation and conditions of forming legal belief. In order to make the legal belief of our citizens as soon as possible, accelerate the pace of the formation of the rule of law society in our country.
