欧洲一体化历史和实践中的《欧洲宪法条约》研究

【摘要】:《欧洲宪法条约》未能获得通过,《里斯本条约》随后取得的成功,使得宪法条约在今天的重要性和意义在大多数研究者心中有所下降。但必须注意的是,《里斯本条约》只是作为《欧洲宪法条约》的替代者和危机局面的拯救者出现的。在这个意义上说,《欧洲宪法条约》更为接近欧盟立法者的理想状态,而《里斯本条约》只是在现实政治压力下的折衷。所以,比起《里斯本条约》,《欧洲宪法条约》的作用并不应当被过分低估,尽管《里斯本条约》取得了很多明显的巨大成功。在本文中,作者将在欧洲一体化的历史和现实背景中,将《欧洲宪法条约》和《里斯本条约》的努力作为一个完整的事件加以研究。 《里斯本条约》在欧盟机构改革的成效远胜于其在象征意义上取得的作用。但《里斯本条约》的前身——《欧洲宪法条约》却本应完成大量的象征意义上的立法,用以培养欧洲公民的宪法爱国主义。欧洲集体认同建设的缺失使得《里斯本条约》这一改革条约(《里斯本条约》原名)的改革是一个半途而废的改革,最初的立法意图并未实现,在将来的欧盟立法中,培养宪法爱国主义和建立欧洲集体认同的大量工作有待完成。一定程度上说,《欧洲宪法条约》为将来立法中完成宪法条约原定目标提供了一个不算完美的范例。 综上,《欧洲宪法条约》的研究并没有过时,这一研究对理解和预测欧盟和欧盟法的未来至关重要。本文第一部分对欧洲一体化历史进程进行介绍;第二部分在分析《欧洲宪法条约》条文的基础上探讨其对于欧盟宪政的影响;第三部分分析《里斯本条约》之于宪法条约的继承和倒退;最后一部分对两个条约在宪政建设上的作用和意义进行分析,结合宪法爱国主义理论对《欧洲宪法条约》这一模式在欧洲集体认同构建上的作用加以揭示。
[Abstract]:The failure of the European Constitutional Treaty and the subsequent success of the Lisbon Treaty have led to a decline in the importance and significance of the Constitutional Treaty in the minds of most researchers today. It must be noted, however, that the Lisbon Treaty only emerged as a substitute for the European Constitutional Treaty and a savior of crisis situations. In this sense, the European Constitutional Treaty is closer to the ideal state of EU lawmakers, while the Lisbon Treaty is only a compromise under realistic political pressure. So the role of the European Constitutional Treaty should not be overestimated compared to the Lisbon Treaty, which has had many notable successes. In this paper, the author will study the efforts of the European Constitutional Treaty and the Lisbon Treaty as a complete event in the historical and realistic background of European integration. The Lisbon treaty has done much better in EU institutional reform than it has done symbolically. But the predecessor of the Lisbon Treaty, the European Constitutional Treaty, was supposed to have completed a great deal of symbolic legislation to foster constitutional patriotism among European citizens. The lack of collective identity in Europe makes the reform of the Treaty of Lisbon (the original name of the Treaty of Lisbon) a half-way reform, but the original legislative intent was not realized, in future EU legislation. Much remains to be done to cultivate constitutional patriotism and build a European collective identity. To some extent, the European Constitutional Treaty provides an imperfect model for future legislation to achieve its original objectives. Overall, the study of the European Constitutional Treaty, which is crucial to understanding and predicting the future of EU and EU law, is not out of date. The first part of this paper introduces the historical process of European integration, the second part discusses its influence on the constitutionalism of the European Union on the basis of analyzing the articles of the European Constitutional Treaty. The third part analyzes the succession and retrogression of the Lisbon Treaty to the constitutional treaty, and the last part analyzes the role and significance of the two treaties in the constitutional construction. Combined with the theory of constitutional patriotism, the role of this model in the construction of European collective identity is revealed.
