古代治庸的规范、实效及启示

【摘要】：“无功即有罪”是中国古代官治的基本观念,对官员的庸碌行为多处以刑罚。中国古代通过职责规范、惩罚规范、预防规范等构建起了比较系统的法律制度,对于维持社会的稳定与发展起到了重要作用。但在专制制度、宗法制度、集权制度基础上形成的官僚政治、情理社会、“非专业”的官员以及“顺民”思想制约了治庸的实际效力。从古代治庸制度的经验教训出发,应基于效率与权利构建责任体系、发挥科学考核的激励作用、为促进效率构建外部监督机制、树立重“大道”轻“小惠”观念等几方面,进一步完善我国的官员治理制度。
[Abstract]:"reactive merit is guilty" is the basic concept of official administration in ancient China. In ancient China, a relatively systematic legal system was constructed through the norms of duty, punishment and prevention, which played an important role in maintaining social stability and development. But on the basis of autocratic system, patriarchal system and centralization system, bureaucracy, rational society, "non-professional" officials and the thought of "obeying the people" restricted the practical effect of ruling the common. Based on the experience and lessons of the ancient rule of mediocrity system, we should construct the responsibility system based on efficiency and rights, give play to the incentive function of scientific examination, construct the external supervision mechanism for promoting efficiency, and establish the concept of attaching importance to the "main road" and "neglecting" the small favor, and so on. Further improve our country's official governance system.
