大地法理学释析

【摘要】：托马斯·贝里提出的大地法理学,为应对生态危机而生的新兴法学理论,其所诠内容含摄环境伦理学整体主义思想之精要。此理论赅地球科学的研究方法,旁涉数学、物理学、地质学、生物学、人类学等多学科。大地法理学之视域着眼于大地、地球,乃至整个宇宙。它的研究目的是因应当下传统法理学对治生态危机的限度,苏息自然界之神圣维度,维护地球共同体之权利,强调人类对生态、地球、宇宙发展的责任和义务。研究内容为人类角色之定位、人类与地球的关系及法律制定的尺度和基础,以达地球共同体背景下,人类与其他自然实体共同增强之生存模式。因由此理论发韧不久,其理论意义应被进一步发掘,随之对其的质疑亦需深入研究。故,该新兴领域待续探讨的问题还很多。
[Abstract]:Thomas Berry's geodetic jurisprudence, a new theory of law born to deal with the ecological crisis, contains the essentials of the holistic thought of environmental ethics. This theory is a comprehensive approach to geoscience, involving mathematics, physics, geology, biology, anthropology, and so on. The horizons of geodetic jurisprudence focus on the earth, and even the whole universe. The purpose of its research is to protect the rights of the earth community according to the limitation of the traditional jurisprudence on the management of ecological crisis, the sacred dimension of the Soviet Union and the responsibility and obligation of human beings to the development of ecology, the earth and the universe. The content of this study is the orientation of human role, the relationship between human beings and the earth, and the scale and basis of law making, in order to achieve the survival mode of human beings and other natural entities enhanced together under the background of the Earth Community. The theoretical significance of this theory should be further explored and its doubt should be further studied. Therefore, the emerging field to be discussed a lot of issues.
