清代、民国云南买卖契约中“第三方群体”研究

【摘要】：以中人为代表的契约"第三方群体",是中华法系契约文明的重要组成部分,也是清代、民国云南财产买卖活动中的重要法律现象。其广泛存在于清代、民国云南买卖契约中,发挥居中说合、促成交易、见证立约、担保债务履行和解决纠纷等作用。这些功能的生成,与当时云南血缘与地缘结合的宗族共同体社会结构、以儒家文化为内核的本土文化传统,以及习惯法主导契约法领域的法制传统密不可分。这一群体的作用机理对当代契约制度具有借鉴价值,今天我们在相关法律制度的设计中,应培育"第三方群体"的当代意义替代者,紧扣中国本土实际构建当代契约的"第三方群体"制度。
[Abstract]:The contract "third party group", represented by the middle, is an important part of the contract civilization of the Chinese legal system and an important legal phenomenon in the property trading activities of the Qing Dynasty and the Republic of China in Yunnan. It widely existed in the Qing Dynasty and the Republic of Yunnan. It played the roles of mediating, facilitating the transaction, witnessing the establishment of the contract, fulfilling the secured debt and resolving disputes. The formation of these functions is closely related to the social structure of the clan community of Yunnan at that time, the local cultural tradition with Confucian culture as the core, and the legal tradition that the customary law dominates the field of contract law. The function mechanism of this group has reference value to the contemporary contract system. In the design of relevant legal system today, we should cultivate the substitute of the contemporary meaning of "third party group". The third-party group system of contemporary contract is constructed closely with China's native country.
