协作共治下构建我国污染企业环保内控机制——兼谈德国公害防治代理人制度

【摘要】：本文以探讨我国环境污染源头为起点,因政府对污染企业单纯外部监管难起实效,对污染国企治理更难上加难,为此必须重视环保领域协作共治,构建我国污染企业环保内控机制,由此引发了污染企业环保内控机制的构建具体问题与借鉴路径选择,最后,本文认为应借鉴德国公害防治代理人制度优点构建我国污染企业环保内控机制,同时通过行政指导、行政补贴等多种柔性行政措施激励环保内控机制实际运行与协作共治。
[Abstract]:This paper takes the source of environmental pollution in China as the starting point, because it is difficult for the government to take the external supervision of the polluting enterprises into effect, and it is even more difficult to deal with the pollution state-owned enterprises, so it is necessary to attach importance to the cooperative management in the field of environmental protection. The construction of the environmental protection internal control mechanism of the pollution enterprises in our country has caused the concrete problems of the construction of the environmental protection internal control mechanism of the pollution enterprises and the choice of the reference path, finally, This paper holds that it is necessary to use the advantages of German environmental hazard prevention agent system for reference to construct the environmental protection internal control mechanism of our country's polluting enterprises, and at the same time to encourage the environmental protection internal control mechanism to run and cooperate with each other through various flexible administrative measures such as administrative guidance and administrative subsidy.
