【摘要】：中国古代耻辱刑的历史十分悠久,在整个中国刑罚史上都有着鲜明的特色。无论是耻辱刑的类型还是惩罚方式,都与其他类型的刑罚有着显著的不同。而且其产生和沿用也与中国的传统文化以及统治思想有着密切的联系。但随着近代经济的发展和社会制度的更迭,耻辱刑已从法律规范中淡出,我国在清末以后的立法中也没有再出现过耻辱刑的规定一种刑罚之所以能绵延几千年,并且在法律体系中占有一席之地,就一定会有其合理性和必然性,我们完全摒弃忽略其存在的价值是不可能同时也是不可取的,有扬弃的吸收才应该是正确的态度。近些年来,在世界的范围内,耻辱刑都有回潮的趋势。我国处于社会转型的时期,现在社会的整体道德水平都在持续的上升,社会对公民道德的要求在不断提高,耻辱刑已经具备了适用的经济条件以及道德基础,并且耻辱刑的适用成本比较低,符合刑罚的经济性要求。在这种实际情况下,笔者通过对中国古代耻辱刑进行了比较深入的研究,阐明了中国古代耻辱刑的概念和种类;中国古代耻辱刑产生的社会基础,包括政治基础、思想基础、文化基础等;中国古代耻辱刑的历史变迁;以及对耻辱刑的评析,包括中国古代耻辱刑的特征,现代各国耻辱刑回潮趋势和对耻辱刑在中国立法可行性的分析。希望能够找出耻辱刑的合理内核,从而取其精华去其糟粕,这对于完善我国的现行法律体系建立法治社会有着重要的现实意义。
[Abstract]:The history of humiliating punishment in ancient China is very long and has distinct characteristics in the whole history of Chinese penalty. Both the type of shame punishment and the way of punishment are significantly different from other types of punishment. Moreover, its emergence and usage are closely related to Chinese traditional culture and ruling thought. However, with the development of modern economy and the change of social system, humiliating punishment has faded out of the legal norms, and there has been no provision of humiliating punishment in our country's legislation after the end of Qing Dynasty. The reason why a punishment can last for thousands of years. And to have a place in the legal system, there will be its rationality and inevitability, we completely abandon the value of its existence is not possible and undesirable, there should be a sublation of absorption should be the correct attitude. In recent years, in the world, there is a trend of humiliating punishment. Our country is in the period of social transformation, now the whole moral level of the society is continuously rising, the demands of the society on the citizen's morality are constantly rising, and the humiliating punishment already has the suitable economic condition and the moral foundation. And the application cost of humiliating punishment is relatively low, which accords with the economic requirement of penalty. In this practical situation, the author makes a deep study of the ancient Chinese humiliating punishment, and expounds the concept and types of the ancient Chinese humiliating punishment, the social basis of the ancient Chinese humiliating punishment, including the political basis, the ideological basis, and so on. The cultural basis, the historical changes of the humiliating punishment in ancient China, and its analysis, including the characteristics of the humiliating punishment in ancient China, the trend of the return of the humiliating punishment in modern countries and the analysis of the feasibility of the legislation of the humiliating punishment in China. It is hoped that we can find out the reasonable core of shame punishment and take its essence away from its dross, which has important practical significance for perfecting the current legal system of our country and establishing a society ruled by law.
