试论依法治国在构建社会主义和谐社会中的作用

【摘要】：“依法治国”理论提出,是伴随着中国共产党执政一起产生、成长、形成、发展起来的。十六届四中全会党中央提出“构建社会主义和谐社会”以来,如何很好地将“依法治国”运用到社会主义市场经济、政治文明与文化发展、生态文明建设、以及和谐社会的构建。成为我们实现依法治国,构建社会主义和谐社会的当务之急。为了实现经济发展方式的转型,实现经济的又好又快的发展,在社会的转型过程中,妥善的处理好经济发展与和谐社会的建设之间的关系,我们就必须实施“依法治国”。只有在社会的各个层面,运用好法律,实施好法治,才能更好的构建“社会主义和谐社会”。本文论述了中国共产党对“依法治国”的理论探索、“依法治国”的理论内涵及基本要求、“依法治国”在构建“社会主义和谐社会”中的作用这三个部分的内容。第一部分论述了以历史时期为线索,阐述了四个重要的历史时期,对“依法治国”的理论探索及其主要的成果。第二部分着重介绍了“依法治国”的定义、基本内涵、及其“依法治国”的基本要求,进而得出依法执政是依法治国在中国的必然要求。第三部分在前两章的基础上,初步探索“法治”与“和谐社会”的内在关联。并相应的指出目前我国社会主义和谐社会建设中存在的突出问题,进而重点论述“依法治国”在促进政治文明、完善社会主义市场经济体制、加强精神文明建设和文化发展、以及构建社会主义和谐社会等一系列重大问题中发挥的作用。
[Abstract]:The theory of governing the country according to law comes into being, grows, forms and develops along with the ruling of the Communist Party of China. Since the CPC Central Committee of the fourth Plenary session of the 16th CPC Central Committee proposed "building a harmonious socialist society," how to apply "governing the country according to law" to the socialist market economy, the development of political civilization and culture, and the construction of ecological civilization, And the construction of harmonious society. It has become an urgent task for us to realize the rule of law and build a harmonious socialist society. In order to realize the transformation of the mode of economic development and realize the good and fast development of the economy, in the process of social transformation, we must properly handle the relationship between economic development and the construction of a harmonious society. Only in all levels of society, the use of law, the implementation of the rule of law, in order to better build a "socialist harmonious society." This paper discusses the theoretical exploration of "ruling the country by law", the theoretical connotation and basic requirements of "governing the country by law", and the function of "governing the country by law" in the construction of "socialist harmonious society". The first part discusses the historical period as the clue, elaborated four important historical periods, the "rule of law" theoretical exploration and its main results. The second part mainly introduces the definition and connotation of "ruling the country by law" and the basic requirements of "governing the country according to law", and then concludes that ruling by law is the inevitable requirement of ruling the country by law. On the basis of the first two chapters, the third part explores the internal relationship between "rule of law" and "harmonious society". It also points out the outstanding problems existing in the construction of the socialist harmonious society in our country at present, and then emphasizes on the importance of "governing the country according to law" in promoting political civilization, perfecting the socialist market economic system, strengthening the construction of spiritual civilization and cultural development. And building a socialist harmonious society and a series of major issues play a role.
