德国“私人保险”和“法定保险”中因果关系认定的“两元性”及其对我国的启示

【摘要】：因果关系的确定问题一直是法学研究领域的重要范畴,德国经过两百多年的司法实践确立了"私人保险"和"法定保险"的两元因果关系认定体系,同时在"私人保险"领域实行"比例因果关系"认定标准,具有一定的合理性和先进性。我国在这两个方面的理论研究尚属空白,在实践方面,保险案件中的因果关系的认定具有认定上的单一性的弊端,简单化地认定因果关系,不加区分地确定认定标准,具有极大的不合理性,效仿德国,确立的"两元性"的因果关系认定体系,对我国具有极大的理论意义和实践意义。
[Abstract]:The determination of causality has always been an important category in the field of legal research. After more than 200 years of judicial practice, Germany has established a two-element causality system of "private insurance" and "statutory insurance". At the same time, it is reasonable and advanced to apply the criterion of proportional causality in the field of private insurance. The theoretical research in these two aspects is still blank in our country. In practice, the identification of causality in insurance cases has the disadvantage of single identification. It has great irrationality, imitating Germany, and establishing the system of "duality" causality is of great theoretical and practical significance to our country.
