我国农村社会法律传播与农村法治建设问题研究

【摘要】：2015年2月初,中共中央、国务院印发了《关于加大改革创新力度加快农业现代化建设的若干意见》,这是中央一号文件连续12年聚焦“三农”问题。今年一号文件五大方面的内容之一就是要围绕做好“三农”工作,加强农村法治建设。由此可见,加强农村法治建设,是时代发展的需要,是顺应历史发展的必然,是全面推进依法治国题中应有之义。然而纵观我国农村社会,法律并没有真正意义上的进入老百姓的生活,有关农村社会的法律法规不完善,农村法律文化缺乏,农民的法律意识淡薄、法律素养缺失,这些都在一定程度上阻碍了农村法治建设的进程。农村法治建设是中国法治建设的重要内容,要建设法治中国,就要在农村实现法治,而要实现农村社会法治建设,必须要加强法律在农村社会的普及与传播,否则,农村法治建设将成为无源之水、无本之木,农村法治建设的梦想将会是竹篮打水一场空。但是,纵观我国学术界的相关方面研究,主要是基于法律传播的相关研究和基于农村法治建设的研究比较多。这些研究成果,就如何进行法律传播,如何推进农村法治建设提出了很多好的建议和对策,既有理论层面的研究,又有实践层面的研究。但是,这些研究遗憾之处是没有把农村社会法律传播与农村法治建设二者有机结合起来。基于此,本文以农村法律传播为切入点,将其与农村法治建设有机结合起来,阐述了二者的关系,并基于农村社会法律传播是农村法治建设的重要途径和载体,从“三个度”(力度、广度、深度)的角度阐述了如何加强农村社会法律传播,促进农村法治建设。
[Abstract]:At the beginning of February 2015, the CPC Central Committee and the State Council issued "opinions on strengthening Reform and Innovation and speeding up the Construction of Agricultural Modernization", which is the first document of the Central Committee focusing on the "three rural issues" for 12 consecutive years. One of the five aspects of document No. 1 this year is to strengthen the construction of rural rule of law by doing well the work of agriculture, rural areas and farmers. It can be seen from this that strengthening the construction of rural rule of law is the need of the development of the times, the necessity of complying with the historical development, and the proper meaning of comprehensively promoting the rule of law. However, throughout the rural society of our country, the law has not really entered the common people's life, the laws and regulations about the rural society are not perfect, the rural legal culture is lacking, the farmer's legal consciousness is weak, and the legal literacy is lacking. To some extent, these have hindered the construction of rural rule of law. The construction of rural rule of law is an important part of the construction of China's rule of law. In order to build a country ruled by law, it is necessary to realize the rule of law in rural areas, and in order to realize the construction of the rule of law in rural society, we must strengthen the popularization and dissemination of law in rural society, otherwise, The construction of rural rule of law will become no source of water, no wood, the dream of rural rule of law will be a bamboo basket water empty. However, there are a lot of related researches in academic circles, mainly based on law communication and rural rule of law. These research results put forward a lot of good suggestions and countermeasures on how to spread the law and how to promote the construction of rural rule of law, both theoretical and practical aspects of research. However, these studies regret that there is no organic combination of rural social legal communication and rural legal construction. Based on this, this paper takes the rural legal communication as the breakthrough point, organically combines it with the rural legal construction, expounds the relationship between the two, and based on the rural social legal communication is an important way and carrier of the rural legal construction. From the angle of "three degrees" (strength, breadth and depth), this paper expounds how to strengthen the spread of law in rural society and promote the construction of rural rule of law.
