萨维尼的历史遗产及其对我国民法典制定的启示

【摘要】：萨维尼是19世纪德国历史法学派最杰出的代表,他与蒂博特之间就民法典的制定而发生的那场著名的论争,对德国民法法典化运动产生了重大而深远的影响,尽管人们对他的思想和观点存在一些认识误区。萨维尼的历史法学理论由历史主义、民族精神及实证主义三个部分组成,历史主义是萨维尼理论体系的基石,民族精神是其核心和灵魂,实证主义乃其表征路径或方法。萨维尼的民法思想植根于其历史法学理论,二者互为表里,相辅相成。我国当前的民法法典化与德国历史法学之时代背景颇为相似,重新梳理萨维尼的历史遗产,对我国民法学研究及民法典的制定有积极的启示意义。
[Abstract]:Savini was the most outstanding representative of the German historical law school in the 19th century. The famous argument between him and Tibbott on the formulation of the civil code had a great and profound influence on the codification movement of the German civil law. Although there are some misunderstandings about his ideas and opinions. Savini's theory of historical law is composed of three parts: historicism, national spirit and positivism. Historicism is the cornerstone of Savini's theoretical system, and national spirit is its core and soul. Positivism is its way or method of representation. Savini's thought of civil law is rooted in his theory of historical law. The current codification of civil law in our country is quite similar to the background of the historical jurisprudence of Germany. Rearranging the historical heritage of Savini has positive implications for the study of civil law and the formulation of civil code in our country.
