论江泽民依法治国思想

【摘要】：以江泽民同志为核心的党的第三代领导集体提出的“依法治国，，建设社会主义法治国家”的治国基本方略和目标，是在我国社会主义法制建设的实践中总结出来的对社会主义法治问题的理论创新，是对马克思主义法治思想、以毛泽东法治思想为核心的党的第一代领导集体的法治思想和以邓小平法治思想为核心的党的第二代领导集体的法治思想的继承和发展。研究江泽民依法治国思想对于我国建设社会主义法治国家，构建社会主义和谐社会具有十分重要的作用和意义。全文共由三个部分组成：第一部分，江泽民依法治国思想的理论渊源和历史背景。这一部分一方面阐述了江泽民依法治国思想形成发展的理论渊源，主要包括马克思主义法治思想、党的第一代领导集体的法治思想以及党的第二代领导集体的法治思想；另一方面论述了江泽民依法治国思想形成所依赖的国际背景和国内背景。第二部分，江泽民依法治国思想的主要内容。这一部分主要从立法、司法、执法、法律监督及普法教育等五个方面全方位的阐述和分析了江泽民依法治国思想博大的内容体系。第三部分，江泽民依法治国思想的时代价值。这一部分从江泽民依法治国思想特色的角度出发揭示该思想的时代价值，江泽民依法治国思想提出了依法治国的治国新方略、确立了德法并举的治国新理念、健全了社会主义的法律新体系。
[Abstract]:The basic strategy and goal of governing the country according to law and building a socialist country ruled by law, put forward by the third generation leading collective of the Party with Comrade Jiang Zemin as the core, It is a theoretical innovation on the issue of socialist rule of law summed up in the practice of the construction of socialist legal system in our country. It is also a theoretical innovation to the thought of Marxist rule of law. The inheritance and development of the rule of law thought of the first generation of the leading collective of the Party with the core of Mao Zedong's thought of ruling by law and the thought of ruling by law of the second generation of the party's leading collective with the core of the thought of Deng Xiaoping's rule of law. It is very important and significant to study the thought of Jiang Zemin governing the country according to law to build a socialist country ruled by law and to build a harmonious socialist society. The thesis consists of three parts: the first part, the theoretical origin and historical background of Jiang Zemin's thought of governing the country according to law. On the one hand, it expounds the theoretical origin of the formation and development of Jiang Zemin's thought of governing the country according to law, mainly including the thought of Marxist rule of law, the thought of ruling by law of the first generation of the Party's leading collective and the thought of ruling by law of the second generation of the party's collective leadership. On the other hand, it discusses the international and domestic background on which the formation of Jiang Zemin's thought of governing the country according to law depends. The second part, the main content of Jiang Zemin's thought of governing the country according to law. This part mainly expounds and analyzes the content system of Jiang Zemin's thought of governing the country according to law from five aspects: legislation, judicature, law enforcement, legal supervision and education of popularizing law. The third part, the time value of Jiang Zemin's thought of governing the country according to law. This part reveals the value of Jiang Zemin from the point of view of the characteristics of the thought of governing the country according to law. Jiang Zemin puts forward a new strategy of governing the country according to law and establishes a new idea of governing the country by virtue and law. We have improved the new legal system of socialism.
