试析布莱克冲突的社会空间结构理论

【摘要】：布莱克的冲突理论主要关注人们对越轨行为的反应及其处理，它涵盖了社会生活的方方面面，是一个全新的研究领领域。布莱克运用了一种全新的范式来理解冲突及其解决，这种范式即案件的社会几何学。布莱克的社会几何学理论早年在《法律的运作行为》一书中被提出，它认为，案件的社会结构影响了法律的量与式，这些结构包括：分层、形态、文化、组织及规范性。布莱克认为，法律的变化在社会结构上有迹可循，，因此，社会结构可以被用来预测和解释法律。在《正义的纯粹社会学》一书中，布莱克沿用了这种研究范式，解析了可能影响冲突及社会控制的各种社会性因素。布莱克对冲突的研究主要从社会控制出发，他认为社会控制是个可变量，并且随着社会的多样性的变化而变化。社会控制的样式也会随着社会空间的变化而变化，布莱克以五种具体的社会控制方式为例说明了这些样式是如何变化的，这五种方式具体是：私力救济、回避、交涉、调处和忍受。在布莱克的理论中，第三方的价值和作用也被提升到了一个十分重要的层面，他认为第三方在冲突中不仅仅起到辅助作用，有时甚至会主导、影响冲突进程。第三方的影响力取决于他所处的社会位置，不同的社会位置决定了第三方介入冲突时的具体角色。布莱克还对第三方是如何影响冲突进程提出了自己的看法。布莱克认为，第三方并非都是中立的，事实上他们往往具有自己的立场，他把这种立场称为派别性或道德性。布莱克用社会引力原则解释派别性，用社会排斥原则解释道德性，他的意思实质上是指，亲密性会影响第三方的判断和调处。最后，布莱克提出，法律事实上也具有派别性，总体上而言，布莱克的冲突理论是对法律理论的延续和发展，他过去一直秉承的纯粹法社会学在社会学的立场上仍然是弃价值和目的于不顾，全心全意地关注人类的外在行为。从这种意义上说，他的社会学理论是一种纯粹社会学理论。
[Abstract]:Black's conflict theory focuses on people's reaction to deviant behavior and its treatment. It covers all aspects of social life and is a new research field. Blake uses a new paradigm to understand conflict and its resolution, which is the social geometry of cases. Black's theory of social geometry was put forward in the book "the operational behavior of Law" in the early years. It holds that the social structure of a case influences the quantity and form of law. These structures include stratification, form, culture, organization and standardization. According to Blake, the changes of law can be followed in the social structure, so the social structure can be used to predict and interpret the law. In the book the Pure Sociology of Justice Black followed this paradigm and analyzed various social factors that might affect conflict and social control. Black's research on conflict mainly starts from social control. He thinks that social control is a variable and changes with the variety of society. The style of social control will also change with the change of social space. Blake takes five concrete ways of social control as an example to illustrate how these styles change. These five ways are: private relief, avoidance, negotiation. To mediate and endure. In Black's theory, the third party's value and function are also promoted to a very important level, he thinks that the third party not only plays a supplementary role in the conflict, sometimes even leads, affects the conflict process. The influence of the third party depends on his social position, and different social position determines the specific role of the third party in the conflict. Blake also offered his views on how third parties affect the conflict process. Black believes that third parties are not always neutral, in fact they tend to have their own position, which he calls sectarian or moral. Blake uses the principle of social gravity to explain factionalism and the principle of social exclusion to explain morality. In essence he means that intimacy will affect the judgment and mediation of third parties. In the end, Blake pointed out that the law has factional character, generally speaking, Black's conflict theory is the continuation and development of the legal theory. The sociology of pure law, which he had been adhering to in the past, still disregarded the value and purpose, and paid full attention to the external behavior of human beings. In this sense, his sociological theory is a pure sociological theory.
