基于法经济学的集体土地价值测算研究

【摘要】:农村集体土地问题近年来受到广泛的关注,其中以耕地面积持续减少最引人瞩目。耕地面积持续减少会直接威胁到中国的粮食安全,进而给中国经济社会发展产生严重影响。于是,如何保护农村集体土地尤其是耕地就成为近年来的研究重点。本文主要从土地价格角度出发,在参考了大量的国内外相关文献的基础上,应用法经济学的理论和分析工具对集体土地价格与国有土地价格进行比较,认为集体土地价格主要由经济价值、生态价值、社会价值三部分构成,集体土地的经济价值主要指反映集体土地的负载和生产功能的经济产出价值,也就是能够在市场上实现的那部分价值;集体土地的生态价值主要指反映集体土地的景观功能,具有涵养水源、水土保持、改善小气候、改善大气质量、保持生物多样性等作用的那部分价值;集体土地的社会价值指反映仓储功能、增殖或储蓄功能,具有保障国家粮食安全,保障农民的养老、医疗、失业的那部分价值。 本文包括七章内容。第一章绪论,叙述了相关理论及国内外研究动态、研究的主要方法和内容等。第二章现行土地产权制度分析,介绍了现行土地制度的形成发展,分析了现行土地制度的特征及其存在的问题。第三章现行产权制度下的土地价格比较分析,包括现行制度下的国有土地价格分析方法,现行制度下的集体土地价格分析方法,国有土地与集体土地价格比较分析等内容。第四章基于法经济学的土地价格分析,包括公共选择理论框架下的集体土地价格分析,理性选择理论框架下的集体土地价格分析,基于法经济学的国有土地与集体土地价格比较分析等内容。第五章以珠海市香洲区、斗门区、金湾区为例对土地价格做了案例分析,包括测算现行珠海市各区集体农用地价格,收集整理各区现行基准地价资料,测算基于法经济学的珠海市各区集体农用地价格,分析比较现行珠海市各区国有土地与集体土地价格,分析比较基于法经济学的国有土地与集体土地价格。第六章现行土地制度改革的政策建议,对现行国有土地制度、现行集体土地制度的改革建议进行了讨论。第七章结论对集体土地价格测算、现行土地制度改革等进行评述。
[Abstract]:The problem of rural collective land has attracted wide attention in recent years, among which the continuous reduction of cultivated land area is the most notable. The continuous reduction of cultivated land will directly threaten the food security of China, and thus have a serious impact on the economic and social development of China. Therefore, how to protect the rural collective land, especially the cultivated land, has become a recent research. From the point of view of land price, based on the reference of a large number of relevant documents at home and abroad, the theory and analysis tools of law and economics are used to compare the price of collective land with the price of state-owned land, and the collective land price is mainly composed of three parts: economic value, ecological value and social value. The economic value mainly refers to the economic output value reflecting the load and production function of collective land, which is the part of the value that can be realized in the market. The ecological value of collective land mainly refers to the landscape function of the collective land, and it has the water source, soil and water conservation, the improvement of the microclimate, the improvement of the air quality and the conservation of biodiversity. The value of the equal role; the social value of the collective land refers to the function of storage, proliferation or savings, which can guarantee the national food security, and guarantee the value of the farmers' pension, medical care and unemployment.
This article includes seven chapters. The first chapter is introduction, which describes the related theories, the research trends at home and abroad, the main methods and contents of the study. The second chapter analyses the current land property system, introduces the formation and development of the current land system, analyzes the characteristics of the current land system and its existing problems. The third chapter is the soil under the current property rights system. The land price analysis under the current system, the analysis method of the state land price under the current system, the analysis method of the collective land price under the current system, the comparative analysis of the state land and the collective land price. The fourth chapter is based on the analysis of the land price of the law and economics, including the analysis of the collective land price under the framework of the public choice theory, and the rationality of the land price analysis. In the fifth chapter, the fifth chapter takes Xiangzhou District, Doumen district and Jin Wan District as an example to analyze the land price, including the calculation of the current price of collective agricultural land in each district of Zhuhai, and collects the current base of each district. Quasi land price data, calculate the price of collective agricultural land based on law and economics in Zhuhai, analyze and compare the current prices of state-owned land and collective land in all areas of Zhuhai, analyze and compare the price of state-owned land and collective land based on law and economics. The sixth chapter of the current policy suggestions on the reform of the current land system, the current state land system, the current state land system, the current state land system, The reform proposals of collective land system are discussed. The seventh chapter concludes the collective land price estimation and the current land system reform.
