马林诺夫斯基法律起源理论试析

【摘要】:布罗尼斯拉夫·马林诺夫斯基(Bronislaw Malinowski,,1884年4月7日-1942年5月16日)是出生于波兰的英国籍人类学家。他建构了以客观民族志记载田野调查研究成果的方式,开创了最早的社会人类学课程。他在初民社会法律制度方面的研究成果,对人类学、法学及社会学的发展产生了重大影响。本文从初民社会的规则、研究初民社会的方法及理论等角度论述了马林诺夫斯基有关初民社会的研究理论和方法及其有关法律起源的观点。第一章首先概括了有关法律起源的各种学说以及马林诺夫斯基有关法律起源的思想。有关法律起源的问题从古到今一直没有统一的观点,有些观点在文化进程中逐渐被淘汰,有些观点则至今仍存在与发展。马林诺夫斯基有关法律起源的观点具有其独特性,并对后来的研究产生了深远的影响。第二章分析了马林诺夫斯基在初民社会调查得到的有关初民社会规则的界定、渊源等。他认为初民社会并非原始杂乱,而是有约束人们生活及规范社会秩序的规则存在,且这种规则与现代社会的法律具有一定的相似性。第三章具体分析了初民社会的规则,并对马林诺夫斯基有关法律起源的思想进行了评价。马林诺夫斯基在初民社会进行了多次调查,获得了非常丰富的研究资料。这些资料具有很高的可信度,通过这些资料,我们对初民社会的制度有清晰的了解,并从这些资料中总结得出有关初民社会规则的结论。第四章论述了马林诺夫斯基进入初民社会研究所采取的田野调查法及功能主义方法论。田野调查法是马林诺夫斯基深入初民社会研究其社会形态的最基本方法,他通过亲身进入初民社会了解其风俗习惯、社会制度等,为进一步研究及得出相关结论打下了基础。功能主义是马林诺夫斯基对初民社会制度和习俗进行等系统研究的主要方法,他将社会的全部文化作为一个整体分析,再将各部分带入整体中,分析每部分所具有的不同功能,这使人类学家对初民社会的研究有了新的视角。马林诺夫斯基对初民社会的研究激发了以后的学者对初民社会规则制度的研究兴趣,使人类学与法学都得到了发展。他所开创的田野调查法将理论与实践结合在一起,将对法律的研究从理论回归到了实践,而功能主义的产生则使人类学和法学的研究有了新的方法及视角,进一步促进了人类学与法学的发展。
[Abstract]:Branislav Ma Lin Novski (Bronislaw Malinowski, was a Polish-born British anthropologist from April 7, 1884 to May 16, 1942. He constructed the way of documenting the achievements of field investigation with objective ethnography and initiated the earliest course of social anthropology. His achievements in the legal system of the early populace had a great influence on the development of anthropology, law and sociology. From the point of view of the rules of the primitive society and the study of the methods and theories of the primitive society, this paper discusses Ma Lin Noowski's research theory and method on the society of the early populace and the viewpoint of the origin of the law. The first chapter summarizes various theories about the origin of law and Ma Lin Novsky's thoughts about the origin of law. There has been no unified view on the origin of law from ancient to present. Some views are gradually eliminated in the process of culture, while others still exist and develop. Ma Lin Noowski's view on the origin of law was unique and had a profound influence on later studies. The second chapter analyzes the definition and origin of the social rules of Ma Lin Noowski in the early civil society survey. He thinks that the primitive society is not original disorder, but there are rules that restrict people's life and regulate social order, and this kind of rule has certain similarity with the law of modern society. The third chapter analyzes the rules of the primitive society and evaluates Ma Lin Noowski's thoughts on the origin of law. Ma Lin Novsky conducted many investigations in the early civil society, and obtained a lot of research data. Through these data, we have a clear understanding of the system of the primitive society, and draw conclusions about the rules of the society from these data. Chapter four discusses the field investigation and functionalism methodology adopted by Ma Lin Noowski. Field investigation is the most basic method for Ma Lin Noowski to study his social formation deeply. He learned his customs, habits, social system and so on by himself, which laid a foundation for further study and conclusion. Functionalism is the main method of systematic research on the social system and customs of the early populace by Ma Lin Noowski. He analyzes the whole culture of the society as a whole, and then brings each part into the whole to analyze the different functions of each part. This gives anthropologists a new perspective on the study of primitive society. Ma Lin Noowski's research on the early folk society has stimulated the later scholars' interest in the study of the rules and regulations of the primitive society, which has led to the development of both anthropology and law. The field investigation method he pioneered combines theory with practice and returns the study of law from theory to practice, while the emergence of functionalism gives anthropology and jurisprudence a new method and perspective. It further promotes the development of anthropology and law.
