我国立法公众参与制度

【摘要】：立法公众参与是民主化的必然要求。国家立法能够得以服从并尊重、从很大程度上来说是因为这个国家的立法是民意的体现、其在立法过程中充分体现了多数人民的利益诉求。无论是从古希腊时期的直接参与和现代的代议制度来看,民主和公正都是其重要的理论基础。目前我国是以人民代表大会的代表来进行民主决策,反映民意。但是因复杂的社会关系而可能会出现代表不能够真正的表达民意或因为误解而导致错误的表达民意的情况。所以本文的写作目的也就在于通过介绍立法公众参与的有关问题来指出中国的法治道路中应该逐步构建和完善当前的代议民主、通过扩大公众参与的范围和完善公众参与的其他更多地不足之处来加快立法民主化进程。本文主要从我国立法公众参与制度的基本理论问题来做简单的介绍,分别对其概念和特征方面说起,并在接下来的文章里从立法过程当中民众参与到其中的必要性文线,强调在将来的立法活动中必须以公众的参与来制定和谐立法,这样才能够建立和谐社会,发展民主制度,解决立法过程中公权力“分离制约”原则的矛盾和提高立法的科学性,加强公民的主体意识,增强法律的稳定性等。再接下来又总结了我国公众参与立法制度的发展实践情况,由此又引出本文谈及的重点问题,即详细的阐述目前我国立法过程中公众参与制度具体存在的问题。本文的最后一部分,在上文提及的问题基础上结合国外一些较合理科学的做法提出一些完善我国目前立法公众参与制度的措施。
[Abstract]:Public participation in legislation is an inevitable requirement of democratization. National legislation can be obeyed and respected, to a large extent, because the legislation of this country is the embodiment of public opinion, which fully reflects the interests of the majority of the people in the legislative process. Democracy and justice are the important theoretical basis for the direct participation in ancient Greece and the modern representative system. At present, our country is to the deputies to the people's Congress to carry out democratic decision-making, reflecting public opinion. But because of complicated social relations, there may be situations where people can't really express public opinion, or misunderstandings lead to wrong expression of public opinion. Therefore, the purpose of this paper is to point out that the current representative democracy should be built and perfected step by step in China's road to rule of law by introducing the relevant issues of legislative public participation. To speed up the process of democratization of legislation by expanding the scope of public participation and improving other shortcomings of public participation. This paper mainly introduces the basic theory of the system of legislative public participation in our country, and starts with the concept and characteristics of the system, and in the following article, from the legislative process to the necessity of public participation in one of the lines. Emphasizing that in future legislative activities, harmonious legislation must be formulated with the participation of the public, so as to build a harmonious society, develop democratic system, resolve the contradiction of the principle of "separation and restriction" of public power in the legislative process and improve the scientific nature of legislation, Strengthen citizen's subjective consciousness, strengthen the stability of law and so on. Then it summarizes the development and practice of the legislation system of public participation in our country, which leads to the key issues discussed in this paper, that is, the specific problems of the system of public participation in the current legislative process of our country. In the last part of this paper, on the basis of the problems mentioned above, some measures to perfect the system of public participation in legislation of our country are put forward in combination with some more reasonable and scientific practices abroad.
