宋代定婚制度初探

【摘要】：中国传统法制中,婚礼制度至唐宋时期已发展成熟,为后世沿用,影响及于周边东南亚诸国。婚礼从学理上被划分为定婚和成婚两大步骤。婚礼制度发展至宋朝由"六礼"转变为"四礼",去繁就简地贴近一般平民生活,但是定婚之礼仍在"四礼"中占有举足轻重的地位。文章以定婚的主体、定婚的要件、定婚的拘束力及法律后果为中心,佐之以《名公书判清明集》中若干案例,对宋代的定婚制度进行探析。
[Abstract]:In the traditional Chinese legal system, the wedding system has grown mature in the Tang and Song dynasties. It is used for later generations and affects the neighboring Southeast Asian countries. The wedding ceremony is divided into two major steps: marriage and marriage.
