法学研究中问题意识的问题化思考

【摘要】：法学研究中的问题意识,主要体现为法学理论对于法治实践的敏感度及涵摄力;问题意识是法学研究或法学理论与法治实践之间的主要媒介。当下法学研究中问题意识的缺失,与我国法学研究及法治进路的双重转型相关,也与法学学科的特性、研究者的知识结构及对待法治现实的态度密切相关。提升问题意识需要推动法学理论研究者法治共识的形成,强化对法治运作实然状态的了解,善于把法治实践的"问题"转化为法学理论研究主题,同时要保持对问题意识的培养和合理导向。
[Abstract]:The problem consciousness in the study of law is mainly embodied in the sensitivity and culvert of law theory to the practice of the rule of law; the problem consciousness is the main medium between the legal research or the law theory and the practice of the rule of law. The lack of the problem consciousness in the present law research is related to the double transformation of the legal research and the rule of law in China, and also with the law discipline. The characteristics of the researchers are closely related to the knowledge structure of the researchers and the attitude towards the reality of the rule of law. The promotion of the problem consciousness needs to promote the formation of the consensus of law theory researchers, strengthen the understanding of the actual state of the operation of the rule of law, and be good at transforming the "problems" of the practice of the rule of law into the subject of the theory of law theory, while maintaining the cultivation of the consciousness of the problem. And reasonable guidance.
