基于语料库的法律程式语功能研究及其应用

【摘要】：法律程式语(Legal formulaic sequences简称FSs),具有"整存整取"的认知特征,是在法律实践中固定下来的多词词串,贯穿了整个司法、立法过程。基于语料库检索,对法律程式语进行功能性聚类研究,可以将高频程式语划分为逻辑功能下三要素及一个特征,分别是处理要素、假定要素、制裁要素及普适性特征。通过对法律程式语的型式及功能研究,进一步加深对法律程式语理论体系的研究,并加强对法律实践的专业理解,同时在教学中更好地实现整体教学法。
[Abstract]:Legal formulaic sequences (FSs), which has the cognitive characteristics of "integration and withdrawal", is a multi word word string fixed in the practice of law. It runs through the whole judicial and legislative process. Based on corpus retrieval, the functional clustering of legal languages can be divided into three elements of logic function. And one characteristic is to deal with the elements, the essential elements, the elements of the sanctions and the characteristics of universality. Through the study of the type and function of the legal programming language, the research on the theoretical system of legal programming is further deepened, and the professional understanding of the legal practice is strengthened, and the overall teaching method is better realized in the teaching.
