私法文化:一种文化语境下的私法研究

【摘要】：法律作为一种文化现象,对其研究应置于文化的视域之中。文化的核心是价值,对法律文化、私法文化的研究重点是其与现代文化价值相一致的价值取向。没有现代私法文化价值作为指导,难以建立理想的现代私法制度。我国目前私法学界存在着对于私法文化问题重视不够、研究不足的问题。应将私法放置在整个现代文化、现代法律文化、现代私法文化的背景之下,探寻与现代文化价值取向相一致的现代法律文化以及现代私法文化的价值诉求,为我国私法制度的构建,尤其是民法典的编纂确立价值基准。
[Abstract]:As a cultural phenomenon, the study of law should be placed in the perspective of culture. The core of culture is value, and the emphasis of research on legal culture and private law culture is its value orientation consistent with the value of modern culture. It is difficult to establish ideal modern private law system without cultural value of modern private law. At present, private law circles in China pay less attention to the cultural problems of private law. Under the background of the whole modern culture, the modern legal culture and the modern private law culture, private law should be placed in the background, and the value demands of the modern legal culture and the modern private law culture should be explored, which are consistent with the value orientation of the modern culture. To establish the standard of value for the construction of private law system, especially the compilation of civil code.
