我国立法监督制度的现状与完善

【摘要】:法是作为社会关系的“调整器”来到人世间的,它为社会成员制定行为规范。而良法是实施依法治国方略、建设中国特色社会主义法治国家的前提和基础。立法监督正是基于这样的现实意义和重大价值成为学术界关注的焦点,它是规范立法活动、提高立法质量、维护法制统一、增强法治观念、保障良法之治的重要措施。本文拟采用价值分析和比较研究相结合的方法,分三部分对完善我国立法监督制度加以探讨。 第一部分,我国立法监督的历史发展及现状。笔者首先论证了立法监督的法理基础:代议制立法存在缺憾、对行政立法的合理怀疑、法的特性是稳定与变革的统一。在此基础上,梳理了我国立法监督制度的历史发展概况,以宪法及相关法律法规的演变为线索,将我国立法监督制度的历史发展大体上划分为三个阶段。同时阐明了我国现行立法监督制度存在的问题与不足。 第二部分,国外立法监督的主要模式及其比较。该部分详细地介绍了世界上通行的三种立法监督模式:代议机关的监督模式、司法机关的监督模式、专门机构的监督模式。这三种立法监督模式各有利弊,一国立法监督模式的最终选择需要根据本国的实际情况,我国应充分考虑三种监督模式的优缺点,来构建既符合本国国情又能充分发挥监督效能的立法监督模式。 第三部分,完善我国立法监督制度的途径与对策。在该部分中,针对我国现行立法监督制度存在的缺陷,笔者提出了完善我国立法监督制度的途径与对策。我国立法监督制度的完善不仅必须坚持宪法至上原则,在我国的宪政体制框架内进行,还要与我国的法治水平相适应,同时坚持以科学监督和民主监督为目标的原则,努力实现我国立法监督的科学化和民主化。从中国的国情出发,优化权力配置以增强监督的相对独立性,扩大立法监督范围,明确立法监督标准,实现立法监督程序的法制化。
[Abstract]:Law comes into the world as a regulator of social relations. Good law is the premise and foundation of implementing the strategy of governing the country according to law and building a socialist country ruled by law with Chinese characteristics. Based on such practical significance and great value, legislative supervision has become the focus of academic attention. It is an important measure to standardize legislative activities, improve the quality of legislation, maintain the unity of legal system, strengthen the concept of rule by law, and ensure the governance of good law. This paper adopts the method of value analysis and comparative study to discuss the perfection of our country's legislative supervision system in three parts. The first part is the historical development and present situation of legislative supervision in China. The author first demonstrates the legal basis of legislative supervision: there are defects in representative legislation, and the characteristics of law are the unity of stability and reform. On this basis, the historical development of China's legislative supervision system is summarized. The historical development of China's legislative supervision system is divided into three stages, taking the evolution of the Constitution and related laws and regulations as the clue. At the same time, it clarifies the problems and shortcomings of the current legislative supervision system in China. The second part, the main mode and comparison of foreign legislative supervision. This part introduces three kinds of legislative supervision modes in the world in detail: the supervision mode of representative organization, the supervision mode of judicial organ and the supervision mode of specialized organization. These three kinds of legislative supervision models have their own advantages and disadvantages. The final choice of one country's legislative supervision mode needs to be based on the actual situation of our country, and our country should fully consider the advantages and disadvantages of the three kinds of supervision models. To build a legislative supervision model that not only conforms to the national conditions but also can give full play to the effectiveness of supervision. The third part, consummates our country legislation supervisory system the way and the countermeasure. In this part, the author puts forward the ways and countermeasures to perfect the legislative supervision system in view of the defects of the current legislation supervision system in our country. The perfection of the legislative supervision system in our country must not only adhere to the principle of the supremacy of the constitution, but also adapt to the level of the rule of law in our country, and adhere to the principle of scientific supervision and democratic supervision. We should strive to realize the scientization and democratization of legislative supervision in our country. According to the national conditions of China, we should optimize the allocation of power to strengthen the relative independence of supervision, expand the scope of legislative supervision, clarify the standard of legislative supervision, and realize the legalization of the procedure of legislative supervision.
