功能比较法的误用与东方主义的变异——从络德睦的《法律东方主义——中国、美国与现代法》谈起

【摘要】：美国法学家络德睦的《法律东方主义——中国、美国与现代法》受到西方20世纪90年代以来批判主义比较法的影响,试图运用话语-权力分析方法,反叛、逆用传统功能比较法,却导致了对功能比较法的误用;同时,由于历史语境差异,络德睦的法律东方主义叙事"移植"到中国,变成理性评价中国近代以来学习西方法治改革的思想障碍,造成东方主义的变异。络德睦提出的东方法律主义不足以成为比较法的新理论范式。
[Abstract]:The American jurist "Law Orientalism-China, America and Modern Law" is influenced by western critical comparative law since 1990s, and tries to use discourse-power analysis method to rebel. The reverse use of the traditional functional comparative method leads to the misuse of the functional comparative method. At the same time, due to the historical context difference, the law orientalism narration of Luo de mun is "transplanted" to China. It becomes the ideological obstacle of rational evaluation of the western rule of law reform in modern China, which leads to the variation of Orientalism. The oriental legalism put forward by Luo Demu is not enough to become the new theoretical paradigm of comparative law.
