中英刑事侦查讯问制度中的人权保障比较研究

【摘要】:人权保障问题不仅是时下人们比较关注的社会热点问题,在国际社会中也是一个非常敏感的话题,它具有一定的广泛性,涉及到的领域方方面面。我认为,在一个具体领域中探讨人权保障问题更具有现实性和实用性。所谓刑事侦查讯问,是指在刑事诉讼中行使国家公权力的专门机关及其工作人员已按照法定程序就犯罪有关事实以言辞方式向犯罪嫌疑人、被告人提问,以促使他们陈述的一种诉讼行为。在我国,侦查讯问是指公安机关、国家安全机关和人民检察院的侦查人员为查明案件的事实真相,依法对犯罪嫌疑人进行诘问以获取其真实供述和辩解的侦查活动。在我国刑事诉讼法规定的七种侦查行为中,讯问犯罪嫌疑人是唯一的必经程序,这就足以证明它在案件侦办过程中的重要地位。该项制度是为保护人们的权利而设定的,但是由于它自身独特的性质和特点,在这项制度实施的过程中侵犯犯罪嫌疑人的权利的问题日益凸显出来。侦查讯问中的人权保障,是人权领域中的组成部分,属于司法人权之列。它不是讲人权和人权保障的一般意义,而是专指人权保障在侦查讯问中的具体目标和所涉及的范围。本文就是试图通过对中英两国在刑事侦查讯问制度和人权理念方面的比较,为我国刑事侦查讯问中的人权保障问题的进步与发展提供一些可用的建议。 本论文除了引言之外,一共包括三个大的部分,具体内容如下: 论文的第一部分,介绍了刑事侦查讯问制度与人权保障的基本问题,包括两者之间的关系、侦查讯问中人权保障的对象与内容以及在侦查讯问中保障人权的可能性。刑事侦查讯问中的人权保障是将人权保障问题放在了刑事侦查讯问这样一个具体的领域中进行探讨,人权是一个非常具有广泛性的问题,所以在探讨具体领域中的人权保障问题之前,必须明确人权与这一具体领域的关系,以及在这一领域中人权保障对象和内容是什么,还有人权保障在这一领域中的可能性。这些问题我都在论文的第一部分作了详细的论述。 论文的第二部分,首先从中英两国的刑事侦查讯问制度入手,论述了两国在制度规定上的不同以及我国在刑事侦查讯问制度上漏洞,这为我国在以后的法律制度完善过程中铲除这些制度漏洞奠定了基础。其次以中英两国的人权理念为切入点,分析了两国在人权理念上的差异。制度与人权理念上的差异都导致了两国在刑事侦查讯问活动中人权保障状况的不同。 论文的第三部分,根据中英两国在制度、人权理念上的差异,再联系我国的实际情况,为我国刑事侦查讯问中的人权保障工作的进步和发展提出了建议,希望我国从完善相关制度和大力开展人权教育等方面入手,推进我国刑事侦查讯问中的人权保障工作的进步。 本文以人权保障问题为切入点,通过对刑事侦查讯问这样一个具体领域中的人权保障问题的剖析,希望可以为我国在刑事侦查讯问中的人权保障问题提供一些可用的建议。
[Abstract]:The issue of human rights protection is not only a hot social issue of concern at present, but also a very sensitive topic in the international community. It has certain extensiveness and involves various fields. It refers to a kind of lawsuit in which a special organ and its staff who exercise state power in criminal proceedings have put questions to suspects and defendants in a verbal manner in accordance with legal procedures in order to urge them to make statements.In China, investigation and interrogation refers to the investigation of public security organs, state security organs and people's procuratorates. In order to find out the truth of the case, the criminal suspect is interrogated in accordance with the law to obtain his true confession and defense. Of the seven kinds of investigation acts stipulated in the Criminal Procedure Law of China, interrogating the criminal suspect is the only necessary procedure, which is sufficient to prove its important position in the process of case investigation. The protection of human rights in investigation and interrogation is an integral part of the field of human rights and belongs to judicial human rights. It is not about human rights and human rights protection. This article attempts to provide some useful suggestions for the progress and development of human rights protection in criminal investigation and interrogation in China by comparing the criminal investigation and interrogation systems and human rights concepts between China and Britain.
In addition to the introduction, this paper consists of three major parts, as follows:
The first part of the paper introduces the basic problems of the system of criminal investigation and interrogation and the protection of human rights, including the relationship between the two, the object and content of human rights protection and the possibility of protecting human rights in the process of investigation and interrogation. Human rights is a very broad issue in such a specific field. Therefore, before we discuss the issue of human rights protection in a specific field, we must clarify the relationship between human rights and this specific field, as well as the object and content of human rights protection in this field, and the possibility of human rights protection in this field. These problems are discussed in detail in the first part of my thesis.
The second part of the thesis begins with the criminal investigation and interrogation systems in China and Britain, and then discusses the differences in the institutional provisions between the two countries and the loopholes in the criminal investigation and interrogation system in China, which lays a foundation for eliminating these loopholes in China's future legal system. This paper analyzes the differences in human rights concepts between the two countries, and the differences in systems and human rights concepts lead to the differences in the protection of human rights in criminal investigation and interrogation between the two countries.
In the third part of the thesis, according to the differences between China and Britain in the system and the concept of human rights, and connecting with the actual situation of our country, the author puts forward some suggestions for the progress and development of human rights protection in criminal investigation and interrogation in China, hoping that China will start with perfecting the relevant system and vigorously carrying out human rights education to promote criminal investigation and interrogation in China.
