司法情景中证据使用策略技术探析

【摘要】：证据使用策略是西方近二十年来发展起来的新兴谎言识别策略,是访谈(审讯)人员主动策略性、结构化对犯罪嫌疑人的询问工作模式。它以社会认知与自我调节为理论基础,建立起以审讯人员观点采择为主动性心理机制,以证据隐瞒、证据呈现、反侦查策略、询问技术及陈述—证据不一致性、前后陈述不一致性等概念与技术为核心的策略系统。在司法实践与策略训练中,通过反侦查策略与言语反应,可以对于提高谎言识别准确率、判别有罪的犯罪嫌疑人与无辜的犯罪嫌疑人、获得真实的罪行供述获得积极效果的验证。
[Abstract]:Evidence use strategy is a new falserecognition strategy developed in the West in the past two decades. It is an active strategy and structured interrogation mode for the suspects by interviewing (interrogating) personnel. Based on the theory of social cognition and self-regulation, it establishes the active psychological mechanism based on the viewpoint of interrogators, the concealment of evidence, the presentation of evidence, the strategy of counter-investigation, the technique of questioning and the inconsistency of declaration-evidence. Inconsistency of statements and other concepts and techniques as the core of the strategic system. In judicial practice and strategy training, by means of counter-investigation strategy and verbal response, we can improve the accuracy of falsehood recognition and distinguish the guilty suspect from the innocent criminal suspect. Obtain a true confession of the crime to obtain a positive effect of verification.
