发展主义人权观的法哲学研究

【摘要】：发展主义人权观是以发展为理念,以人民为中心,以人的全面发展为崇高目标,建构的中国特色的人权模式。这一立论有深厚的理论和现实基础,彰显"发展是人类社会永恒的主题",契合和平与发展的时代潮流,回应"人民对美好生活的向往"所涵摄的全部权利要求。发展主义人权观是对西方自然主义人权观、功利主义人权观、福利主义人权观、新自由主义人权观认真回顾和深刻反思的基础上提出和证成的人权观,是马克思主义人权观中国化的最新成果。
[Abstract]:The concept of human rights of developmentalism is a human rights model with Chinese characteristics, which takes development as the concept, the people as the center and human's all-round development as the lofty goal. This theory has a profound theoretical and practical foundation, showing that "development is the eternal theme of human society", in line with the trend of peace and development, and responding to all the right demands contained in "people's yearning for a better life". The concept of human rights of development doctrine is put forward and proved on the basis of careful review and profound reflection of the view of human rights of western naturalism, utilitarianism, welfare and neoliberalism. It is the latest achievement of Marxist view of human rights in China.
