新时期我国法治型政治文化构建路径分析

【摘要】：自2012年召开党的十八大以来,新一届中央领导集体提出了许多新的思想和理论,其中依法治国理论这一重要思想得到了进一步的丰富和发展,同时也为推进国家法律体系和完善法律制度指明了方向和建设途径。当今在努力构建和谐社会、实现中华民族伟大复兴的大背景下,又召开了党的十八届四中全会,第一次将法治作为全会主题,这标志着依法治国方略进入新阶段。尤其在当代全面深化改革的背景下,法治建设势在必行。当然,建立社会主义法治国家除了要进一步完善法律体系以及政治体制之外,还要有与之相适应的政治文化作精神支柱。所谓“政治文化”,被学者引用最多的内涵是指一个民族在特定时期流行的一套政治态度、信仰和感情。它要解决的是公民政治认同与政治参与问题。我们这里所说的形成与法治相适应的政治文化就是指要在社会上形成一股崇尚法律、崇尚民主的氛围,让公民对民主政治与法治建设形成共识,并为之奋斗。建立社会主义法治国家,需要以政治文化作支撑,需要政治文化的营养来滋润。因此要构建当代中国法治型政治文化即从政治文化的视角来探讨法治建设。所谓法治型的政治文化是一种全新的政治文明,是指公民崇尚法律,法律至上,并以法律武器维护自身的合法权利,使政治参与形成制度化、法治化的政治文化。本文首先交代了研究的缘由和意义、国内外研究现状、研究思路和方法以及创新点、不足等。在梳理文献的基础上,厘定了与法治型政治文化相关的概念并介绍了法治与政治文化之间的关系,这也是本文第一部分所介绍的。紧接着第二部分阐述的内容是西方主要资本主义国家在构建法治型政治文化方面取得的成就以及对中国的启示。第三部分提出问题,与西方主要资本主义国家法治建设比较,探讨当代中国法治型政治文化出现的现状及其影响因素。最后一部分也就是本文的重点内容,从不同的角度来论述如何构建我国的法治型政治文化,占据了本文的大量篇幅,也是本文的最终落脚点。
[Abstract]:Since the 18th National Congress of the Party was held in 2012, the new central leading collective has put forward many new ideas and theories, among which the important idea of governing the country by law has been further enriched and developed. At the same time, it also points out the direction and construction way for promoting the national legal system and perfecting the legal system. Under the background of building a harmonious society and realizing the great rejuvenation of the Chinese nation, the fourth Plenary session of the 18th CPC Central Committee was convened again. The theme of the plenary session was the rule of law for the first time, which marked a new stage in the strategy of governing the country according to law. Especially under the background of deepening the reform in an all-round way, the construction of rule of law is imperative. Of course, in order to establish a socialist country ruled by law, we should not only perfect the legal system and political system, but also have the corresponding political culture as the spiritual pillar. The so-called "political culture" refers to a set of political attitudes, beliefs and feelings of a nation in a particular period. What it wants to solve is citizen political identity and political participation problem. The political culture that we say is suitable for the rule of law is to form an atmosphere of advocating the law and democracy in the society so that citizens can form a consensus on the construction of democratic politics and rule of law and strive for it. The establishment of a socialist country ruled by law requires the support of political culture and the nourishment of political culture. Therefore, to construct the political culture of ruling by law in contemporary China is to probe into the construction of rule of law from the perspective of political culture. The so-called political culture of rule by law is a brand-new political civilization, which means that citizens advocate the law, the law is supreme, and the legal weapon is used to safeguard their own legal rights, so that political participation can be institutionalized and ruled by law. This paper first explains the reason and significance of the research, the current situation of research at home and abroad, research ideas and methods, innovative points, shortcomings and so on. On the basis of combing the literature, this paper defines the concepts related to the political culture of the rule of law and introduces the relationship between the rule of law and the political culture, which is also introduced in the first part of this paper. Then the second part expounds the achievements of the main western capitalist countries in constructing the political culture of rule of law and the enlightenment to China. The third part puts forward the question, compares with the rule of law construction of the western main capitalist countries, discusses the present situation and the influence factor of the political culture of the rule of law in contemporary China. The last part is the key content of this paper, from different angles to discuss how to construct the political culture of rule of law in our country, occupied a lot of space in this article, and is the final foothold of this article.
