南宋真德秀法律思想探微

【摘要】：宋代是中国封建社会发展的成熟期。稳固的经济基础为上层建筑提供了坚实的物质保障。而作为上层建筑的传统儒学也在理论体系上得到了升华,逐渐发展为更具哲学思辨性的理学,并对封建社会的意识形态产生了深远影响。 本文选取真德秀的法律思想为论述客体。作为南宋晚期著名理学家,他经历了南宋晚期的动荡时局,身怀国家存亡的忧患意识,同时,他又深谙理学宗义,故而在理学政治化过程中起到了推波助澜的作用。本文以《西山先生真文忠公文集》为基础,试图阐述真德秀在理学框架下所构筑的法的世界。本文在历史唯物主义的指导思想下,运用史学与法学相结合的方法,详细地介绍了真德秀的法律思想内容,包括宗法思想、人治思想、刑法思想、息讼思想等。同时,通过对真德秀法律实践的分析,从侧面展现真德秀的法律思想。笔者在文章最后,有条理地分析了真德秀法律思想的特点,既映射了传统的宗法思想,更体现了浓厚的理学光辉,形成独具特色的法律思想体系。系统地整理和分析真德秀的法律思想,使读者对南宋晚期理学家的法律思想以及其历史影响有更深层次的认识和理解。真德秀作为一代名臣,其法律思想对后世封建社会产生重要影响,甚至其中的部分理念对现代社会的法制体系构建也有所启迪。本文的撰写旨在探究真德秀法律思想富含的深厚哲学底蕴,以及展现当时先进的法学理念和法律实践情况。
[Abstract]:Song Dynasty was the mature period of the development of Chinese feudal society. The solid economic foundation provides the solid material safeguard for the superstructure. As a superstructure, the traditional Confucianism has been sublimated in the theoretical system, gradually developed into a more philosophical speculative Neo-Confucianism, and had a far-reaching impact on the ideology of feudal society. This paper chooses the legal thought of Zhenderxiu as the object of discussion. As a famous Neo-Confucianism in the late Southern Song Dynasty, he experienced the turbulent times in the late Southern Song Dynasty and had the consciousness of suffering and survival of his country. At the same time, he also understood the Zong Yi of Neo-Confucianism, so he played an important role in the process of politicization of Neo-Confucianism. Based on the collected works of Mr. Xishan's True Wen and Zhong Gong, this paper attempts to expound the world of law constructed by Zhendexiu under the framework of Neo-Confucianism. Under the guiding ideology of historical materialism, this paper introduces in detail the content of Zhendexiu's legal thought, including patriarchal thought, rule of man thought, criminal law thought, information litigation thought and so on, using the method of combining historiography and law. At the same time, through the analysis of the legal practice of Zhenderxiu, it shows the legal thought of Zhenderxiu from the side. At the end of the article, the author systematically analyzes the characteristics of the legal thought of Zhendexiu, which not only reflects the traditional patriarchal thought, but also reflects the brilliance of Neo-Confucianism and forms a unique legal thought system. In order to make readers have a deeper understanding of the legal thought of the Neo-Confucianism in the late Southern Song Dynasty and its historical influence, the author systematically collated and analyzed the legal thought of Zhenderxiu. As a famous official of a generation, Zhenderxiu's legal thought had an important influence on the feudal society of later generations, and even some of the ideas were enlightening to the construction of the legal system of modern society. The purpose of this paper is to explore the profound philosophical background of Zhenderxiu's legal thought, and to show the advanced legal ideas and legal practice at that time.
