简论孟德斯鸠三权分立学说

【摘要】：三权分立学说已经诞生有二百多年了,其主要精神受到英国资产阶级革命的影响,直接起源于洛克的分权理论。该学说突出了以权力制约权力的根本价值和内涵,并且作为现代法哲学理论的渊源和近代宪政制度的根本原则具有历史进步性和积极意义。文章通过追溯分权学说的起源,分析了三权分立学说的进步性和局限性,并论述了其对我国司法改革的现实启示。
[Abstract]:The doctrine of separation of powers has been born for more than 200 years, the main spirit of which is influenced by the British bourgeois revolution and originated directly from Locke's theory of separation of powers. The theory highlights the fundamental value and connotation of restricting power by power, and as the origin of modern philosophy of law and the fundamental principle of constitutional system in modern times, it has historical progress and positive significance. By tracing the origin of the theory of separation of powers, this paper analyzes the progress and limitation of the doctrine of separation of powers, and discusses its practical enlightenment to the judicial reform of our country.
