先秦时期生态文明建设法哲学思想探究

【摘要】：20世纪70年代后,生态文明与可持续发展问题受到人们的普遍关注。生态文明的核心观念和核心要求就是人与自然和谐相处,这一和谐的要求是以人占主导地位为前提的人与自然环境的和谐,要建设和谐社会和生态文明社会。党的十七大报告中所讲的“生产发展、生活富裕、生态良好的文明发展道路”同样体现了人与自然和谐的要求,也是对生态文明要求的十分精辟的表达。 中国作为历史悠久的文明古国,早在先秦时期就形成了“天人合一”的哲学思想,先秦思想家提出的一系列关于尊重生命、节约资源、保护环境的生态智慧,为我们今天实现生态文明提供了不可多得的宝贵思想。深入发掘中国传统生态保护法哲学思想,这对完善中国生态法律制度和建设当代中国的生态文明,实现人类和环境的和谐相处具有深远意义。本文探讨先秦时期的生态意识和生态法律思想,从中挖掘适于我国当代生态文明建设的智慧之光,从先秦生态保护的法哲学思想给予我们的启示,结合当前我国生态保护的环境法治现状,以期完善我国生态文明建设的法治体制,实现我国的生态文明和社会和谐。
[Abstract]:Since 1970's, ecological civilization and sustainable development have been paid more and more attention. The core concept and requirement of ecological civilization is harmony between man and nature, which is based on the harmony between human being and natural environment, and the harmonious society and ecological civilization society should be built. The report of the Seventeenth National Congress of the Communist Party of China (CPC) says "the road of civilization development with rich life and good ecology" also embodies the requirement of harmony between man and nature, and it is also a very incisive expression of the requirement of ecological civilization. As an ancient country with a long history, as early as the pre-Qin period, China formed the philosophical thought of "harmony of nature and man". A series of ecological wisdom about respecting life, saving resources and protecting environment were put forward by pre-Qin thinkers. For us today to achieve ecological civilization to provide rare valuable ideas. It is of great significance to explore the philosophy of Chinese traditional ecological protection law to perfect Chinese ecological legal system, to construct the ecological civilization of contemporary China and to realize the harmony between human beings and the environment. This paper probes into the ecological consciousness and the ecological legal thought of the pre-Qin period, excavates the light of wisdom suitable for the construction of the contemporary ecological civilization of our country, and gives us the enlightenment from the legal philosophy thought of the ecological protection of the pre-Qin period. In order to perfect the legal system of ecological civilization construction in our country and realize the ecological civilization and social harmony in our country, we should combine the current situation of environmental legal system of ecological protection in our country.
