董必武法治思想研究

【摘要】：董必武可算是见证中国近代史发展的人物,他先后经历了辛亥革命、北伐战争、土地革命、抗日战争、解放战争和社会主义建设。而他的法治思想就是在这样的经历中逐渐形成的,很有研究的价值。 本文分为四个部分： 第一部分是前言。主要包括董必武的简介和当下学界对于董必武法治思想研究的现状,以及本文的研究框架和思路方法等。 第二部分是董必武法治思想的形成。从两个方面进行了阐述,一方面是理论前提,另一方面是时代背景。 第三部分是本文的重点部分,讲述了董必武法治思想的主要内容。分别从董必武的立法思想、司法思想、执法思想和守法思想进行了阐述,另外还着重的阐述了董必武法治思想的教育形式以及董必武关于法律人才的培养问题。 第四部分是董必武法治思想的实践价值及不足。本部分主要是结合董必武的切身经历阐述了董必武的法治思想对我国各个时期的影响,以及董必武的法治教育思想对于当代教育的影响。
[Abstract]:Dong Biwu can be regarded as a witness to the development of China's modern history. He has experienced the 1911 Revolution, the Northern Expedition War, the Agrarian Revolution, the Anti-Japanese War, the War of Liberation and the construction of socialism. His thought of rule of law is gradually formed in such an experience, very valuable for research. This article is divided into four parts: the first part is the preface. It mainly includes Dong Biwu's brief introduction and the present situation of the academic research on Dong Biwu's thought of rule of law, as well as the research frame and thinking method of this paper. The second part is the formation of Dong Biwu's thought of rule of law. From two aspects of the elaboration, on the one hand is the theoretical premise, on the other hand, is the background of the times. The third part is the key part of this paper, the main content of Dong Biwu's thought of rule of law. Respectively from Dong Biwu's legislative thought, judicial thought, law enforcement thought and law-abiding thought, it also expounds the educational form of Dong Biwu's thought of rule of law and the cultivation of legal talents. The fourth part is the practical value and deficiency of Dong Biwu's thought of rule of law. This part is mainly based on Dong Biwu's personal experience to expound the influence of Dong Biwu's thought of rule of law on each period of our country, and the influence of Dong Biwu's thought of rule of law education on contemporary education.
