法的不确定性命题研究

【摘要】：人类的本性难免有感情性弱点，而法律恰是没有感情的。法律能够克服人类非理性的情感因素的消极影响，主要原因就在于法律及其运行具有确定性的特质。确定性本该是法的优秀特质和精神之所在，寄托着人们对法律维护安全、稳定与秩序的美好希冀。法的不确定性是一个与法的确定性相对的命题，尽管法律的明确性、稳定性、安定性、形式主义理性以及裁判的确定性等相关概念得到了深刻的研究与挖掘，但这不能掩盖法具有不确定性这一特征。由于语言的模糊性、理性的不可靠性，都导致了法的不确定性。经过20世纪的科学探索和理论思考，关于法律内在本性的一个新观念开始凸现出来。虽然我们人类是生活在“确定性”之上的，，但我们绝对不能忽略不确定性的存在。确定性是我们对于法律的追求，但在追求法律的确定性过程中，我们发现法律并非是由那些确定性连接而成的有机体。20世纪的自然科学和社会科学，关于不确定性的认识和研究也越来越深入、越来越全面，不确定性永远不会消失，对于未来的决定，无论其大小，总是在缺乏确定性的情况下做出的。法的不确定性是天然存在的，它不可能被完全消除，认为法律是绝对确定的机械法学主张是有失偏颇的。但如果认为法是绝对不确定的，又会陷入不可知论的深渊。因此，我们总是在不确定性中寻找确定，通过研究法的不确定性，从而实现法的确定性追求。
[Abstract]:Human nature is bound to have emotional weaknesses, and the law is no emotion. Law can overcome the negative influence of human irrational emotional factors, the main reason lies in the certainty of law and its operation. Certainty is supposed to be the essence and spirit of law. The uncertainty of law is a proposition opposite to the certainty of law, although some related concepts such as clarity, stability, formalism, certainty of judgment and so on have been deeply studied and excavated. However, this cannot conceal the uncertainty of the method. The ambiguity of language and the unreliability of rationality lead to uncertainty of law. After the scientific exploration and theoretical thinking in the 20 th century, a new idea about the inherent nature of law began to emerge. Although we humans live on certainty, we must not ignore the existence of uncertainty. Certainty is our pursuit of law, but in the pursuit of legal certainty, we find that law is not an organism of certainty. The understanding and research on uncertainty is more and more thorough and comprehensive. Uncertainty will never disappear. The future decisions, no matter how big or small, are always made in the absence of certainty. The uncertainty of law is natural, it can not be completely eliminated, and it is biased to claim that law is absolutely certain. But if the law is absolutely uncertain, it will fall into the abyss of agnosticism. Therefore, we always look for certainty in uncertainty, and by studying the uncertainty of law, we can realize the pursuit of certainty of law.
