英、美城市规划公众参与制度研究

【摘要】：近年来,随着我国公民社会的建设与法制体系的逐步健全,公民民主意识不断提高,在民主法治建设以及公众参与方面我国的探索和尝试成效显著,如将重大事项听证制度、公正制度,信息公开制度以及公众参与立法制度等建立完善。不断扩大公众参与的范围,提高了公众的参与热情,打牢社会基础,大力促进社会主义民主法治建设。不过公众参与的范围仍有很大的拓展空间,城市规划领域就是其中之一笔者选取城市规划领域中的公众参与制度加以研究,是因为公众参与规划还是一个新兴的课题,实践中已经有了此方面的要求,也进行了有益的探索,但是,我国距离建立有效的参与制度还任重道远,亟需加以关注和重视。在英国和美国,公众参与历经半个世纪的发展,已成为城市规划过程中必不可少的法定环节并形成了一套完备的法律制度,自上而下的法律体系已十分健全,对方法的研究也较成熟,并且不断创新。这些都对我国城市规划领域公众参与的探索和发展有着借鉴意义。本文介绍了城市规划过程中美、英两国所执行的公众参与制度,旨在将城市规划领域美、英的公众参与概况反映出来,为我国相关领域公众参与的发展完善发挥借鉴作用。第一,对城市规划领域两国公众参与的内涵和历史发展情况进行介绍,阐述公众参与的内涵以及城市规划领域公众参与的意义,对美、英两国公众参与城市规划所精力的几个重要的发展阶段进行回顾；第二,对英美公众参与城市规划进行了法理分析,系统介绍了英美两国的公众参与模式,阐述了英美两国公众参与的成因,为下文具体研究公众参与制度提供了依存依据；第三,分别论述了英国、美国城市规划公众参与的法律体系、制度、程序以及保障机制；最后,介绍了我国当前公众参与城市规划中存在的问题,分析我国与英美两国的差距,指出英、美制度值得我国学习和借鉴的地方,分析美、英两国的制度带给我们的启示,促使我国相关制度逐渐完善起来。
[Abstract]:In recent years, with the construction of civil society and the gradual improvement of the legal system, the citizen's democratic consciousness has been improved constantly, and the exploration and attempt of our country in the construction of democracy and the rule of law and public participation have achieved remarkable results, such as the hearing system of major matters. Fair system, information disclosure system and public participation in the legislative system, and so on to establish and perfect. Expanding the scope of public participation, increasing the enthusiasm of public participation, laying a solid social foundation, and vigorously promoting socialist democracy and rule by law. However, the scope of public participation still has a lot of space to expand. The urban planning field is one of them. The author chooses the public participation system in the field of urban planning to study, because the public participation in planning is still a new topic. The practice has already had this aspect request, also has carried on the beneficial exploration, but our country is still a long way from establishing the effective participation system, urgently needs to pay attention to and pay attention to. In the United Kingdom and the United States, after half a century of development, public participation has become an essential legal link in the urban planning process and a complete legal system has been formed, with a sound legal system from top to bottom. The research on methods is mature and innovative. All these are helpful to the exploration and development of public participation in urban planning. This paper introduces the system of public participation in the process of urban planning in China and the United Kingdom, aiming at reflecting the general situation of public participation in the field of urban planning, so as to play a reference role in the development and perfection of public participation in relevant fields in China. First, it introduces the connotation and historical development of public participation in the field of urban planning, and expounds the connotation of public participation and the significance of public participation in the field of urban planning. A review of several important stages of public participation in urban planning in Britain and the United Kingdom; Secondly, it analyzes the public participation in urban planning, systematically introduces the mode of public participation in the United States and the United States, expounds the causes of public participation in the United States and the United States, and provides the basis for the following concrete research on the system of public participation. Thirdly, it discusses the legal system, procedure and safeguard mechanism of public participation in urban planning in the United Kingdom and the United States. Finally, the paper introduces the problems existing in the public participation in urban planning in China, analyzes the gap between China and the United States, points out that the British and American systems are worthy of our country to learn and draw lessons from, and analyzes the enlightenment brought to us by the systems of the United States and the United Kingdom. To promote the gradual improvement of relevant systems in China.
