中俄短期自由刑制度比较研究

【摘要】：短期自由刑符合刑罚轻缓化和保障人权等刑罚发展的总趋势。本文在对短期自由刑概念界定和短期自由刑的基本理念研究的基础上，通过对中国与俄罗斯短期自由刑制度的对比找到双方的问题所在。并进一步结合我国短期自由刑制度在理论和实践中存在的主要问题，提出建议和意见，以达到改进和完善我国短期自由刑制度的目的。本文主要采用了历史演绎和对比分析的方法，除引言、结语，，共分五部分。第一部分通过对短期自由刑基本问题的研究，明确了短期自由刑的概念和基础理念；第二部分对最具争议的短期自由刑存废问题进行分析，进而提出笔者的见解；第三部分用历史嬗变的角度对中俄双方进行了比较；第四部分从立法现状、司法适用情况和执法现状进行比较，找出双方存在的问题，并对俄罗斯的经验教训进行了总结；第五部分在前四部分研究的基础上，提出完善我国短期自由刑制度的具体措施。
[Abstract]:Short-term free penalty accords with the general trend of penalty development, such as mitigation of penalty and protection of human rights. On the basis of the study of the definition of short-term free punishment and the basic concept of short-term free punishment, this paper finds out the problems of both sides by comparing the system of short-term free punishment between China and Russia. In order to improve and perfect the system of short-term free punishment in China, suggestions and suggestions are put forward according to the main problems existing in the theory and practice of the system of short-term free punishment in China. This article mainly uses the historical deduction and the contrast analysis method, apart from the introduction, the conclusion, altogether divides into five parts. The first part makes clear the concept and basic idea of short-term free punishment through the research of the basic problem of short-term free punishment, the second part analyzes the most controversial issue of short-term free punishment, and then puts forward the author's opinion. The third part makes a comparison between China and Russia from the angle of historical evolution, the fourth part compares the current situation of legislation, judicial application and law enforcement, finds out the problems existing in both sides, and summarizes the experience and lessons of Russia. The fifth part puts forward the concrete measures to perfect the system of short-term liberty penalty on the basis of the first four parts.
