社会理论法学:定位、功能与前景

【摘要】：中国的社会理论法学研究在新世纪正式展开。社会理论法学并非严格意义上的法学,而是科学系统对法律系统的外部观察,倡导建构和运用宏观社会理论,从社会整体视角讨论法律问题;与经验法社会学不同,社会理论法学关注实证法,重视经由法教义学的中介,影响法律系统的实际运作,致力于现代法律的全面理性化;在当代的法理学、宪法学、部门法学以及新兴的互联网法学、全球法研究领域,社会理论法学都可能构成知识增长点。接续马克思以来的理论传统,推进社会理论法学研究,需要更多学者的共同努力。
[Abstract]:The study of social theory law in China has been officially carried out in the new century. Social theoretical law is not a strict sense of law, but a scientific system of external observation of the legal system, advocating the construction and use of macro-social theory, from the perspective of society as a whole to discuss legal issues. Different from the sociology of empirical law, social theoretical law pays attention to positive law, attaches importance to the actual operation of the legal system through the intermediary of legal education, and devotes itself to the overall rationalization of modern law. In the fields of contemporary jurisprudence, constitutional law, departmental law, emerging Internet law and global law research, social theoretical law may constitute the growth point of knowledge. It is necessary for more scholars to make joint efforts to continue the theoretical tradition of Marx and promote the study of social theoretical law.
