未成年人犯罪的社区矫正研究

【摘要】： 未成年人犯罪不仅具有现实的社会危害性,而且具有长期的、潜在的社会危害性。如果今天的未成年犯罪人改造不成功,就必然成为未来的成年犯罪人。因此,研究对未成年犯罪人的矫正十分必要,尤其是针对未成年犯罪人的自身特点进行社区矫正研究,从理论与实践上均具有重要意义。从理论上看,通过该研究能够丰富预防未成年犯罪人重新犯罪的理论,从实践上看,该研究所取得的成果能够指导司法实践,对未成年犯罪人进行有效的矫正与改造,从实际上削弱犯罪的后备军力量,从实质上减少犯罪的增长。同时,该研究对于未成年犯罪的立法与司法实践具有重要的影响作用,能够为未成年犯罪的立法与司法的进一步健全与完善提供必要的理论依据。未成年人作为社会的特殊群体,在生理、心理、认识能力等方面与成年人相比较均具有很大差别,他们的可塑性较强。因此,根据未成年人的特点,有针对性地对未成年人犯罪实行社区矫正是必要与可行的。本文研究的总出发点是尊重与保护未成年犯罪人的人权,降低未成年人犯罪率,增加公共安全的系数。在研究未成年犯罪人社区矫正基本理论问题的基础上,研究我国未成年人犯罪社区矫正中存在的主要问题,分析对未成年人犯罪社区矫正的必要性与可行性,进而提出建立我国未成年人犯罪社区矫正制度的基本设想。
[Abstract]:Juvenile delinquency not only has realistic social harmfulness, but also has long-term and potential social harmfulness. If today's minor offenders are not successfully reformed, they will inevitably become adult criminals in the future. Therefore, it is necessary to study the correction of minor offenders, especially to study the characteristics of minor offenders in community correction, which is of great significance both in theory and practice. Theoretically, the research can enrich the theory of preventing juvenile offenders from recommitting crimes. In practice, the results obtained by the study can guide judicial practice and effectively correct and reform juvenile offenders. It actually weakens the reserve force of crime and substantially reduces the growth of crime. At the same time, the research plays an important role in the legislation and judicial practice of juvenile crime, and can provide the necessary theoretical basis for the further improvement and perfection of the legislation and judicature of juvenile crime. As a special social group, minors are different from adults in physiology, psychology and cognitive ability, and their plasticity is strong. Therefore, according to the characteristics of minors, it is necessary and feasible to carry out community correction of juvenile delinquency. The general starting point of this study is to respect and protect the human rights of juvenile offenders, reduce the juvenile crime rate, and increase the coefficient of public safety. On the basis of studying the basic theoretical problems of community correction of juvenile delinquents, this paper studies the main problems existing in the community correction of juvenile delinquents in China, and analyzes the necessity and feasibility of community correction of juvenile delinquents. Then put forward the establishment of juvenile delinquency community correction system of the basic ideas.
