有组织犯罪会造成社会福利的增加还是减少—一个数理方法

【摘要】： 有组织犯罪作为一种较个人犯罪范围更广、社会影响更深远的犯罪活动,长久以来一直受到法学家和社会学家的批判,如何抑制并消灭有组织犯罪也成了他们的一个研究方向。 本文首先分析了有组织犯罪出现的社会原因并概述了有组织犯罪的特征。接着本文运用经济学中Nash-Cournot模型和Stackelberg模型说明在一定条件下有组织犯罪的出现实际上会造成社会福利的增加。然后本文逐渐放松模型假设,来分析不同情况下有组织犯罪对社会福利的影响。本文同时讨论了当犯罪侦破部门和定罪部门职能分离时有组织犯罪对社会福利的影响以及为使社会福利最大化两部门应采取的政策,并分析了有组织犯罪自身的犯罪行为对犯罪市场乃至社会福利造成的影响。最后本文分析了有组织犯罪存在的经济效益上的合理性。
[Abstract]:As a kind of criminal activity with wider scope and more far-reaching social impact, organized crime has been criticized by jurists and sociologists for a long time. How to suppress and eliminate organized crime has become a research direction for them. This paper first analyzes the social causes of organized crime and summarizes the characteristics of organized crime. Then this paper uses the Nash-Cournot model and Stackelberg model in economics to show that the emergence of organized crime under certain conditions will actually lead to the increase of social welfare. Then this paper gradually loosens the model hypothesis to analyze the influence of organized crime on social welfare under different circumstances. This paper also discusses the impact of organized crime on social welfare when the functions of crime detection department and conviction department are separated, and the policies to be adopted to maximize social welfare. It also analyzes the influence of organized crime itself on the criminal market and social welfare. Finally, this paper analyzes the rationality of the economic benefits of the existence of organized crime.
