【摘要】：法律移植是中国法制现代化的必然需要。经过理论与实践的检验,法律移植已经被证明是我国最终实现法制现代化的一条重要途径。百余年的法律移植路,既有成功的经验,又有失败的教训。在经济全球化浪潮的冲击下,随着我国法制现代化的不断推进,法律移植面临着新的挑战与问题。如何迎接这些挑战与解决这些存在的问题,是本文尝试探索与解决的任务。该论文共分四个部分。第一部分对法律移植的概念和法制现代化的内涵特征进行了简要分析。并进一步说明了法律移植是中国法制现代化的必然需要。文章第二部分对我国近现代法律移植的历史进行了梳理,着重分析了其法律移植的进步意义和历史局限性。我国法律移植的历史被划分为四个时期,依次是清末时期的法律移植、民国时代的法律移植、建国后至十一届三中全会期间的法律移植和十一届三中全会后我国的法律移植。第三部分是关于中国法制现代化中法律移植面临的挑战与存在的问题。法律移植面临着与“本土资源论”的争论,同时也有全球化的挑战。关于法律移植的问题,该部分主要从法理移植、立法移植和法律移植后的效果三个方面进行分析。在前面分析的法律移植历史与问题的基础上,本文第四部分探讨了未来中国法律移植的方向及路径。该部分又分为两小部分,第一部分是未来我国法律移植的基本原则。第二小部分从五个方面分析了未来法律移植的具体路径。
[Abstract]:Legal transplantation is the inevitable need of the modernization of China's legal system. Through the examination of theory and practice, legal transplantation has been proved to be an important way to realize the modernization of legal system in China. Under the impact of the tide of economic globalization, with the development of our legal system modernization. Legal transplantation is facing new challenges and problems. How to meet these challenges and solve these existing problems is the task of this paper to try to explore and solve. This paper is divided into four parts. The first part briefly analyzes the concept of legal transplantation and the connotation of legal modernization, and further explains that legal transplantation is the inevitable need of legal modernization in China. The second part combs the history of modern law transplantation in our country. The history of legal transplantation in China is divided into four periods: the legal transplantation in the late Qing Dynasty and the legal transplantation in the Republic of China. From the founding of the people's Republic of China to the third Plenary session of the 11th CPC Central Committee and the third Plenary session of the Eleventh Central Committee of the CPC Central Committee, the third part is about the challenges and problems faced by the legal transplantation in the modernization of the Chinese legal system. Faced with " The argument of "the theory of local resources". At the same time, there is also the challenge of globalization. On the issue of legal transplantation, this part is mainly from the legal theory transplantation. On the basis of the previous analysis of the history and problems of the legal transplantation, this paper analyzes the effect of the legislative transplantation and the legal transplantation. Part 4th of this paper discusses the future direction and path of Chinese legal transplantation. This part is divided into two small parts. The first part is the basic principles of the future legal transplantation in China. The second part analyzes the specific path of the future legal transplantation from five aspects.
