唐代御史台司法职能研究

【摘要】： 御史制度是中国传统法律制度中一个非常富有特色的制度,由于其在维护专制皇权、肃清吏治及保障国家正常活动等诸多方面发挥着重要作用,因而中国古代的历代统治者都十分注重强化御史制度的效能及其运行的制度化和法制化。唐代是御史制度发展较为完善的一个阶段,建立了一整套从中央到地方行之有效的司法制度,唐代御史台在拥有监察职能的基础上又被赋予了司法审判权,使其权力呈现出广泛性和多样性的特点,这是古代司法制度完备系统的一个体现,也是古代法制文明的一个重要标志。本文从唐代御史台的司法职能入手,对唐代御史台的弹劾权、司法审判权等权能进行了分析,并且总结归纳出御史制度运作过程中的影响因素以及唐代御史制度的特点,从而更加肯定了一个观点,即御史台不仅仅只是单纯拥有监察权的职能机构,而是兼具司法审判和监察多重权能的司法机构。
[Abstract]:The system of imperial history is a very characteristic system in Chinese traditional legal system, because it plays an important role in maintaining autocratic imperial power, purging officials and safeguarding the normal activities of the country and so on. Therefore, the rulers of ancient China paid much attention to strengthening the efficiency of the system of imperial history and the institutionalization and legalization of its operation. The Tang Dynasty was a relatively perfect stage of the development of the system of imperial history. Established a set of effective judicial system from the central to the local, the Tang Dynasty imperial court on the basis of the supervisory function has been given judicial jurisdiction, so that its power presents the characteristics of universality and diversity. This is an embodiment of the complete system of the ancient judicial system and an important symbol of the ancient legal civilization. This article starts with the judicial functions of the imperial court of the Tang Dynasty and impeaches the power of impeachment of the imperial court of the Tang Dynasty. Judicial power and other powers are analyzed, and summed up in the process of the imperial history system operating factors and the characteristics of the Tang Dynasty imperial history system, thus more affirmed a point of view. That is, the imperial court is not only a functional institution with supervisory power, but also a judicial institution with multiple powers of judicial judgment and supervision.
