高龄化背景下老年人医疗保险之立法因应——日本老年人医疗保险立法之考察

【摘要】：人口高龄化对社会保险提出了新的挑战。医疗保险虽然并非以年老为保险事故,但伤病发生几率却与年龄之间存在密切关联。日本为应对高龄化背景下老年人医疗保险的特殊需求,先后颁布《老人福祉法》、《老人保健法》、《高龄者医疗确保法》等法律,实施以老年人为对象的特别医疗保险制度,其路径均为通过医疗保险制度间的财政调整或连带推进老年人医疗费用在现役世代与高龄世代之间的均衡负担。我国目前亦呈现出高龄化加速的趋势。以日本为参照,我国应当以统一老年人保费负担标准与保险待遇给付水平为前提,谋求三项医疗保险制度间合理的财政调整方式,从而确保所有老年人均能于罹患伤病时及时获得必要的医疗保险待遇。
[Abstract]:The aging of the population poses a new challenge to social insurance. Medical insurance does not take old age as an insurance accident. In order to cope with the special needs of medical insurance for the elderly in the context of aging, Japan has promulgated the Law on the Welfare of the elderly and the Law on Health Care for the elderly. Laws such as the Law on Medical Insurance for the elderly implement a special medical insurance system for the elderly. Its path is to promote the balanced burden between the active generation and the senior generation through the financial adjustment among the medical insurance system or to promote the medical expenses of the elderly. China is also showing the trend of accelerating the aging age. Japan is the main source of this problem. Reference. On the premise of unifying the standard of premium burden for the elderly and the level of insurance benefits, China should seek a reasonable financial adjustment between the three medical insurance systems. This ensures that all older persons receive the necessary health insurance in time of injury.
