唐代刑部的司法职能

【摘要】： 在唐代,刑部是中央三大司法机关之一,其与大理寺、御史台共同执掌整个中央的司法。根据律令的明文规定,结合唐代有关司法实践的具体史料,刑部有以下司法职能:受诏独立审判案件、参与“三司推事”、对案件进行复核、死刑复奏、参与议刑、录囚、执行殊旨别敕。刑部由于受封建制度固有弊端的影响,其在行使司法职能的过程中,难免会受到其它制度和非制度因素的制约。在这种状态下,各种权力之间纵横交错,相互牵制。刑部作为当时司法体制的一部分,其司法职能的行使状况便自然的受到当时整个大环境的掣肘。在前期,刑部的司法职能总体是实际履行的,刑部是作为一个拥有实职的机关存在的。到中后期,刑部的地位逐渐下降,其具有的司法职能便或多或少的受到了削弱。
[Abstract]:In the Tang Dynasty, the Department of torture was one of the three major judicial organs of the Central Committee, which, together with the Dali Temple and the Royal Taiwan, headed the entire central administration of justice. According to the provisions of the laws and decrees, combined with the specific historical materials of the Tang Dynasty on judicial practice. The Ministry of torture has the following judicial functions: independent trial of cases by the edict, participation in the "three divisions of judges", review of cases, reconsideration of the death penalty, participation in the discussion of the sentence of execution and recording of prisoners. Because of the influence of the inherent malpractice of the feudal system, the Ministry of punishment is bound to be restricted by other institutional and non-institutional factors in the process of exercising its judicial functions. As a part of the judicial system at that time, the judicial function of the Ministry of torture was naturally restricted by the whole environment at that time. The judicial function of the Department of Criminal Justice is actually carried out, and the Ministry of Criminal Justice exists as an organ with real duties. In the middle and later period, the status of the Department of Criminal Justice gradually drops, and its judicial function is more or less weakened.
