和谐新农村法制建设问题研究

【摘要】： 中国是一个农业大国,农村问题历来是中国的根本问题之一。在当代中国,和谐新农村建设是和谐社会建设的重要组成部分;而农村法制建设是和谐新农村建设的重要组成部分。加强农村法制建设不仅是和谐新农村建设的重要内容,更是和谐新农村建设的有力保障。然而,长期以来,我国理论界对农村法制建设问题关注不多,成果甚少。本文对我国农村法制建设的现状进行分析,在借鉴国外经验的基础上,提出了完善我国农村法制建设的几点对策,以期活跃对这一重大问题的研究。除引言外,本文共分四大部分。第一部分是和谐新农村与法制建设的基本内涵及其相互关系。包括和谐新农村与法制建设的基本内涵、和谐新农村建设与法制建设的关系等问题的分析。第二部分是我国和谐新农村法制建设的现状及成因。包括现阶段我国和谐新农村法制建设取得的成就、存在的问题及其成因等问题的论证。第三部分是国外农村法制建设及其对我国农村法制建设的启示。包括日本、美国、韩国农村法制建设的概况以及对我国农村法制建设的启示等问题的分析。第四部分是完善和谐新农村法制建设的对策。具体包括加强农村立法水平、完善农村法律体系,完善农村执法体系、确保严格高效执法,完善农村司法体系、确保司法公正,全面增强农民群众的法律素质四个方面。
[Abstract]:China is an agricultural country, the rural problem is one of the essential problems in the contemporary China. Chinese, the construction of harmonious new countryside is an important part of the construction of a harmonious society; and the legal system construction is an important part of the construction of harmonious new countryside. To strengthen the legal construction in rural areas is not only an important part of the construction of harmonious new countryside, it is guarantee the construction of harmonious new countryside. However, for a long time, the theory circle of our country pay attention to legal construction in rural areas is not much, little achievement. The status of rural legal construction in China are analyzed, on the basis of the experience abroad, put forward how to perfect the rural legal construction of our country countermeasure research on the major issues in the active period.
In addition to the introduction, this article is divided into four parts.
The first part is the basic connotation of harmonious new countryside and legal system construction and their relationship, including the basic connotation of harmonious new countryside and legal system construction, the analysis of the relationship between new rural construction and legal system construction.
The second part is the current situation and causes of the legal system construction of the harmonious new countryside in China, including the achievements, problems and causes of the new rural harmonious legal system construction at present stage.
The third part is about the construction of rural legal system in foreign countries and Its Enlightenment to China's rural legal system construction, including the general situation of rural legal system construction in Japan, the United States, South Korea, and the enlightenment to China's rural legal system construction.
The fourth part is the countermeasures to perfect the harmonious new countryside legal construction. Including strengthen the legislative level, improve the rural legal system, improve the rural law enforcement system, to ensure the strict and efficient law enforcement, improve the rural judicial system, ensure judicial justice, strengthen the four aspects of peasants' legal quality.
