失地农民权利保护的法理学分析

【摘要】：“失地农民”这个词汇已经越来越被关注，这是我国城市化进程必然的结果，也是城市化进程中不可忽略的重要问题。保障失地农民的相关权利，这是征地过程中所必须做到的。本文充分借鉴国内外对于该选题的研究方法及所得出的结果，除了引言和结语部分外，，主要从四个方面进行了严谨的分析探讨：第一部分主要是概念的界定，首先是失地农民的含义，根据学者的相关研究成果，目前我国对失地农民的概念还没有一个统一的模式，主要是从一般意义上、社会学意义上、法学意义上来剖析的。本选题主要是从法学角度对失地农民进行研究。任何一个问题的研究都是在被研究者含义明确的基础上进行的，只有明确了研究对象的主体概念，才能明确方向。其次研究的是失地农民的特征，任何一个群体的存在都有其区别于其他群体的特征，作为失地农民来说，最主要的一个特征就是作为农民的身份，但却失去了农民所应该享有的土地使用权，本文的正文部分主要从四个方面分析了失地农民的特征。再次，本章还研究了权利的含义以及失地农民权利的范围。失地农民权利的范围主要是从失地农民应享有的基本权利和失地农民应当受到重视的其他权利两个方面来分析。第二部分主要是从法理的角度对失地农民享有权利的合法性、正当性以及相关的价值理论进行分析的。首先，从法理的角度论述了失地农民权利存在的正当性的相关证明。分析了失地农民应有的生活状态以及社会地位。最后，文章着重的从法理价值理论的角度分析了失地农民的权利保护问题，其中包括人权价值、平等价值和自由价值。任何一个权利都有它存在的理论依据，人权理论是最首要的价值理论之一，当社会弱势群体存在的时候，把人权理论提出来更是尤为重要。何为平等，从法学的角度也可以将平等理解为公平正义。自古以来，公平正义的社会状态都是人们所追求的理想生活环境。第三部分主要是根据目前失地农民所生存的现状，对失地农民相关权利所处的困境以及产生的原因进行了分析。首先，分析权利所处的困境，主要是土地财产权及相关生存型权利的丧失，其中包括土地财产权、劳动权、保障型权利等相关权利；还有就是相关政治性权利的弱化，主要有选举权和被选举权、身份平等权、结社自由权。其次，分析了目前这种困境所产生的原因，征地相关法律法规先天不足、“公共利益”界定不清、征地补偿标准不适当等方面。最后，通过对国外失地农民问题的研究，分析值得我国借鉴的地方。第四部分讨论健全我国失地农民权利保障法律制度的建议。首先，通过对国外失地农民问题的研究，分析值得我国借鉴的地方。其次，从立法层面讲述，第一，完善土地产权制度，第二，严格界定“公共利益”范围。第三，优化土地征用程序，健全征地监督机制。第四，建立科学的征地补偿机制。然后，从法实施层面分析，保证司法、执法、监督的合法及有效性。最后，探讨其他机制：确立“一元化”户籍制度的改革目标以及加大对失地农民的再就业工作力度等等。
[Abstract]:The term " lost land farmer " has been paid more and more attention , this is the inevitable result of the urbanization process in our country , it is also an important problem that can not be neglected in the urbanization process . It is necessary to guarantee the relevant rights of the lost peasants , which is necessary in the land acquisition process . In addition to the introduction and conclusion part , this paper gives full reference to the research methods and the results of this topic at home and abroad , except the introduction and the conclusion part , mainly from four aspects : The first part is mainly the definition of the concept , the first is the meaning of the lost farmers , according to the scholars ' relevant research results , the present country does not have a unified mode on the concept of the lost farmers . The second part analyzes the legitimacy , legitimacy and relevant value theory of the rights of the lost peasants from the angle of jurisprudence . First , the author points out the relevant proof of the legitimacy of the rights of the lost peasants from the angle of jurisprudence . At last , the article puts emphasis on the protection of the rights of the lost peasants from the angle of jurisprudence value theory , including the human rights value , the equal value and the free value . In the third part , the author analyzes the predicament and the causes of the rights of lost farmers according to the present situation of farmers ' survival . First of all , the author analyzes the causes of the rights of land property rights , labor rights and security rights , and analyzes the reasons for the current predicament , the lack of the definition of public interest and the inadequate compensation standards . Finally , through the study of foreign farmers ' problems , this paper analyses the places worthy of reference . The fourth part discusses the suggestion of perfecting the legal system of guaranteeing the rights of lost peasants in our country . First , through the study of the problem of foreign farmers abroad , it is worth to draw lessons from China . Secondly , from the legislative level , the first , perfect the land property right system and the second , strictly define the scope of the " public interest " .
