弘扬法治精神与当代中国法治实践

【摘要】： “法治精神”并不是一个崭新的词汇,但在中国却因为党的十七大报告而具有了崭新的时代意义。抓住这个极富学术价值与时代气息的问题,可以为法学的深入发展寻找到一个新的具有反思性和创新性的理论切口,为法律体系的重构和法律体制的创新提供富有时代性与世界性的精神动力。正是在这一意义上,笔者满怀期待地展开了对法治精神的语义分析、针对性分析、培育和提升分析,以求阐述出我国弘扬法治精神所需要考虑到的时间、空间因素以及其过程中本土资源的发掘与利用,通过回顾改革开放三十余年与新中国建立六十周年的法治建设成就,揭示出我国改革开放三十余年、新中国建立六十年法治精神的嬗变,从而拓宽我们对法治的认识视野,进而为我们提供崭新的理论资源,并最终提出民众法治自觉意识的内化,由此,在法学理论上为实现法治精神的全面落实做出必要的理论准备。“法治精神”是一个融法治的善治精神、民主精神、人权精神、公正精神、理性精神、和谐精神的有机综合体。中华民族并非天然地具有现代法治精神,法治精神融入我们的民族精神之中也并非朝夕可成,中国的法治精神培育之路也不是自然而然的历史发展过程。中国的法治发展所采取的是以政府为主导的建构式路线,现代法治精神的传播也有赖于政府的推进、领导团队和领袖人物对中国社会与法治精神的认识与把握以及民众对中国法治状况与法治精神的自我认识。法治精神的培育与弘扬过程,是法治精神融入我们民族精神的过程,也就是实现中华民族法治自强的过程。在这一过程中,我们需要从政府主导型的法治建构式模式,逐步走向一种政府与全民互动参与的,以对中华民族的法治精神培养为核心,并以实现社会自治为目标的复合型法治发展模式。

The spirit of rule of law is a spirit of good governance, democracy, human rights, justice and reason. Harmonious spirit of organic synthesis. The cultivation of the spirit of rule of law in China is not a natural process of historical development. The development of the rule of law in China takes the government as the leading constructive line, and the dissemination of the modern spirit of the rule of law also depends on the promotion of the government. The understanding and grasp of the Chinese society and the spirit of the rule of law by the leading team and the leaders, and the self-understanding of the state of the rule of law and the spirit of the rule of law by the people, and the cultivation and promotion of the spirit of the rule of law. The spirit of the rule of law is the process of integrating the spirit of the rule of law into our national spirit, that is, the process of realizing the self-strengthening of the rule of law of the Chinese nation.
