对“垃圾短信”的法律思考

【摘要】: 近年来,伴随着“拇指经济”——手机短信业务的发展,大量的垃圾短信也开始泛滥。如同城市街头的“牛皮癣''影响市容一样,这些手机“牛皮癣”也困扰着亿万手机用户。尽管成为2008年央视“3.15”晚会的重点曝光对象,垃圾短信依然大行其道。自从2008年4月12321网络不良与垃圾信息举报受理中心成立以来,截止至2009年2月31日该受理中心共接获举报垃圾信息996877起。更让人出其不意的是,2009年的央视“3.15”晚会再次把矛头对准了垃圾短信。 近年来,有关监管部门也在不断地推出对垃圾短信的整治措施,可效果却差强人意。这其中的原因到底是什么?治本之策在哪里?在此背景下,本文从法律的角度深入分析了垃圾短信屡禁不止、治理困难的症结所在,并以此提出相应的对策和建议。全文分为三个部分: 第一部分:问题的提出。通过对垃圾短信相关统计数据以及2008年、2009年两届“3.15”晚会曝光的垃圾短信事件的分析,展现当前垃圾短信泛滥的局面,并在此基础上提炼出本文的主题,即从法律的角度对垃圾短信所作的思考。 第二部分:垃圾短信相关法律问题的分析。首先,由于目前我国法律上还没有对垃圾短信进行准确的界定,因此本文在总结垃圾短信特征的基础上,提炼出其定义。在对垃圾短信做出界定之后,结合生活实际和“3.15”晚会曝光的垃圾短信事件,深入分析了多年来垃圾短信屡禁不止的三个法律原因。第一,现阶段关于垃圾短信息监管的法律法规不健全,难以对其进行有效的规制。第二,《消费者权益保护法》不能有效规制商家不当搜集、泄露消费者个人信息的行为以及《个人信息保护法》的缺失,为垃圾短信的滋生提供了有利的环境。第三,电信运营商作为短信通道的提供者,应该义不容辞地承担起社会责任来为用户提供通畅、安全的短信网络服务。但是,在利益的诱惑面前,电信运营商往往疏于承担社会责任,从而纵容了垃圾短信的泛滥。 第三部分:相关对策和建议。基于第二部分对垃圾短信泛滥的原因分析,本文从三个方面提出了相应的对策和建议。首先应当建立健全相关法律法规,对垃圾短信实行有效规制。包括针对垃圾短信的监管,制定专门的法律和完善《广告法》,对垃圾短信广告实行良性引导;其次应完善《消费者权益保护法》,约束商家不当搜集泄露消费者个人信息的行为;同时还应尽快出台《个人信息保护法》,从源头上斩断垃圾短信产业链。最后文章提出应从四个方面来加强电信运营商的社会责任,即明确电信运营商的技术丌发责任、明确电信运营商监控和处理垃圾短信的责任、明确电信运营商对手机用户信息安全的管理责任以及明确电信运营商违法行为的法律责任。
[Abstract]:In recent years, with the development of "thumb economy"-mobile phone text messaging business, a large number of spam messages have begun to flood, just like the city street "psoriasis" affect the appearance of the city. These phones, known as psoriasis, are also haunting hundreds of millions of mobile phone users. Despite being the focus of CCTV's 3.15 party on 2008, spam messages are still popular. Since the opening of the 12321 Center for Internet abuse and Spam reports on April 2008, By February 31st 2009, the reception center had received 996877 reports of spam. What was even more surprising was that the 2009 CCTV "3.15" party had once again taken aim at spam messages. In recent years, the relevant regulatory authorities are also constantly introducing the regulation of spam SMS measures, but the effect is not satisfactory. What is the reason for this? What is the solution to the problem? Under this background, this paper deeply analyzes the crux of the repeated prohibition of spam SMS and the difficulty of managing it from the angle of law, and puts forward corresponding countermeasures and suggestions. The full text is divided into three parts:. The first part: put forward the question. Through the analysis of the statistical data related to spam messages and the analysis of the spamming incidents exposed by the two sessions of the "3. 15" evening on 2008 and 2009, the situation of the current flood of spam messages is revealed. On this basis, the theme of this paper, that is, from the perspective of the legal thinking of spam SMS. The second part: the analysis of the legal problems related to spam SMS. Firstly, because there is no accurate definition of spam SMS in our country, this paper summarizes the characteristics of spam SMS. Refining its definition. After defining spam messages, combined with the reality of life and the spamming incident exposed at the "March 15" party, this paper analyzes in depth the three legal reasons for the repeated prohibition of spam messages over the years. First, At the present stage, the laws and regulations on the supervision of garbage short messages are not perfect, and it is difficult to regulate them effectively. Second, the Consumer Rights and interests Protection Law cannot effectively regulate the improper collection of businesses. The behavior of divulging consumers' personal information and the lack of the personal Information Protection Law provide a favorable environment for the spamming of spam messages. Third, telecom operators act as providers of SMS channels. It should be duty-bound to assume social responsibility to provide users with smooth and secure SMS network service. However, in the face of the temptation of interest, telecom operators often neglect to assume social responsibility, thus conniving the proliferation of spam messages. The third part: the related countermeasures and suggestions. Based on the second part of the analysis of the causes of spam SMS flooding, this paper puts forward the corresponding countermeasures and suggestions from three aspects. First, we should establish and improve the relevant laws and regulations, Effective regulation of spam SMS, including the regulation of spam SMS, the establishment of special laws and the perfection of Advertising Law, and the sound guidance of spam SMS advertising; Secondly, we should perfect the Law on Protection of consumers' Rights and interests, and restrict the behavior of improper collection and divulging of consumer's personal information. At the same time, the personal Information Protection Law should be issued as soon as possible to cut off the junk message industry chain from the source. Finally, the article puts forward that the social responsibility of telecom operators should be strengthened from four aspects, that is, to clarify the technical development responsibility of telecom operators. It is clear that telecom operators should be responsible for monitoring and handling spam messages, that telecom operators should be responsible for information security of mobile phone users, and that telecom operators should be legally responsible for illegal activities.
