民国时期新疆司法制度研究

【摘要】： 民国时期的新疆,在司法现代化的大背景下,逐渐开始了司法制度从古代到现代的变革,现代意义的司法制度得以初步确立和运行,并且通过司法实践开展了有关的司法活动,这一时期的努力对建国以后新疆的司法制度的建设和发展奠定了一定的基础。本文主要围绕民国时期新疆的司法制度建设展开,文章主要分为四个部分。第一部分主要是对民国时期新疆的社会背景进行简要的介绍,以便把该时期司法制度的建设融入大的社会背景中。第二部分是司法机构的组织建设,分别从审检机构的建设、监狱的建设与狱政改良和律师与公证制度三个方面进行展开,尤其是要对审判机构的建设进行详细的梳理。第三部分是审判和诉讼制度,主要是介绍审判制度的革新和刑民诉讼制度在新疆的初步确立与实践。第四部分是对民国时期新疆司法制度建设的评议,指出成就及特色,找出建设中的不足及其原因。在此基础上,可以使我们对新疆地区的近代司法转型与变革历程有一个了解与认识,总结变革中的经验与教训,以期从中管窥新疆法制现代化的历史进程。
[Abstract]:In the background of judicial modernization in the period of the Republic of China, Xinjiang gradually began the transformation of judicial system from ancient to modern, the judicial system of modern meaning was established and operated preliminarily, and the relevant judicial activities were carried out through judicial practice. The efforts of this period laid a foundation for the construction and development of the judicial system in Xinjiang after the founding of the people's Republic of China. The article is divided into four parts. The first part is a brief introduction to the social background of Xinjiang during the period of the Republic of China. In order to integrate the construction of the judicial system into the social background in this period. The second part is the organizational construction of the judiciary, which is carried out from three aspects: the construction of the judicial organs, the construction of the prison system and the reform of the prison administration, and the system of lawyers and notarization. In particular, the construction of judicial institutions should be combed in detail. The third part is the system of trial and litigation. It mainly introduces the innovation of the trial system and the preliminary establishment and practice of the criminal procedure system in Xinjiang. Part 4th is a review of the construction of the judicial system in Xinjiang during the period of the Republic of China, pointing out the achievements and characteristics. On the basis of this, we can have an understanding and understanding of the modern judicial transformation and reform process in Xinjiang, and sum up the experience and lessons in the reform.
